The facts are that, despite several years of study, EPA scientists believe the science around chlorpyrifos is unresolved, and that further evaluation of the science should be done - and that EPA will make a decision about the registration of the pesticide by the deadline set forth in the law. The Ninth Circuit refused to short-circuit the process established by Congress to evaluate the safety of chlorpyrifos, affording EPA the necessary time to conduct a proper evaluation under the law of the science and the studies on chlorpyrifos and provide clarity about the pesticides' safety to the American people.
