RESPONSE OF THE DEFENDANT , COMBUSTION ENGINEERING, INC., TO THE REQUEST FOR PRODUCTION OF DOCUMENTS PROPOUNDED BY THE PLAINTIFFS
NOW INTO COURT, through undersigned counsel, comes the
defendant, Combustion Engineering, Inc., who responds to the
plaintiffs' Request for Production of Documents as follows:
REQUEST NO. 1:
The purchase agreement detailing the terms and conditions under which Combustion Engineering, Inc. acquired all the assets of Refractory & Insulation Corporation in 1963.
RESPONSE TO REQUEST NO. 1:
The defendant objects to this Request on the grounds that the requested documents are so numerous that to produce them at the time and place requested by the plaintiffs would be unduly burdensome to the defendant. Without waiving this objection, the defendant responds that the requested documents will be produced at a time mutually convenient to the plaintiffs and the defendant at the offices of the defendant's corporate counsel, Mr. Robert Preston; Arter & Hadden; in Cleveland, Ohio.
REQUEST NO. 2:
The purchase agreement detailing the terms and conditions under which Combustion Engineering, Inc. acquired the Insulation Division of the M.H. Detrick Co. in 1964.
RESPONSE TO REQUEST NO. 2:
The defendant objects to this Request on the grounds' that the requested documents are so numerous that to produce them at the time and place requested by the plaintiffs would be unduly burdensome to the defendant. Without waiving this objection, the defendant responds that the requested documents will be produced at a time mutually convenient to the plaintiffs and the defendant at the offices of the defendant's corporate counsel, Mr. Robert Preston? Any material safety data sheets pertaining to ceramic fiber products manufactured by Combustion Engineering, Inc.

The defendant objects to this request on the grounds that the requested documents deal with a material referred to by the plaintiffs as "ceramic fiber products." This term was not defined by the plaintiffs, and the defendant is unable to respond to this request due to the plaintiffs' use of this vague, ambiguous term. The defendant further objects on the grounds that the requested documents are irrelevant to the issues in these cases, and are not reasonably calculated to lead to the discovery of admissible evidence, since they do not deal with asbestos, asbestos dust, asbestos fiber, and/or asbestos-containing products.

Any brochures or other marketing pamphlets pertaining to ceramic fiber products manufactured by Combustion Engineering, Inc.
