Environmental Protection Agency Region 4 Air Enforcement Branch 61 Forsyth Street, SW Atlanta, Georgia 30303 INSPECTION REPORT Facility Inspected Chick-fil-A 1459 Riverstone Parkway Canton, Georgia 30114 Inspection Date: November 2, 2023 Facility Programmatic ID AIR 0400000013057EPA30 LAT: 34.2519 LON: -84.4726 Inspection Type Clean Air Act (CAA) National Emission Standards for Hazardous Air Pollutants (NESHAP) - Asbestos Inspectors Pamela Storm Introduction An inspection pursuant to Section 114 of the CAA was conducted on November 2, 2023, at Chick-fil-A located at 1459 Riverstone Parkway in Canton, Georgia 30114 (the facility). The unannounced inspection was conducted by Pamela Storm who possesses EPA inspector credentials to conduct CAA NESHAP asbestos inspections. The facility is a fast-food restaurant. The inspector discovered that renovation/demolition activity was occurring at the facility through a tip received, field observations, and permit #R02307-107 issued on October 5, 2023, by the City of Canton. The permit lists Hill, Foley, Rossi and Associates as the Facility owner and Horizon Construction Company as the contractor. The permit states that renovations are to include a new, dual-lane, overhead, drive-thru canopy; parallel, drive-thru cockpit expansion; replacement of the store-front with a sideaccess door; a new HVAC split system; modification of millwork at the service area and drive-thru; and demolition of the existing, single-lane, overhead, drive-thru canopy. The purpose of the inspection was to determine compliance with the CAA NESHAP Asbestos Standard and the regulations promulgated at 40 CFR Part 61, Subpart M, for the activity conducted at the facility. The EPA Region 4 CAA NESHAP asbestos program targets facilities for inspection located in the State of Georgia based on tips/complaints; permits issued on a local level; demolition and/or renovation/abatement notices sent to the State; and other relevant information concerning renovation/demolition activities at regulated facilities. This inspection was conducted based on the tip received and the aforementioned permit issued for the Facility. Facility Information The facility is a fast-food restaurant. CAA Asbestos Inspection Report: Inspection Date: Chick-fil-A 1459 Riverstone Parkway Canton, GA 30114 11/2/2023 Page 1 of 2 Inspection Inspection The EPA inspector met with Jeremy Lay, the supervisor at the site with Horizon Construction, upon arrival at the facility. The inspector presented her inspector credentials and explained that EPA was conducting the inspection of the aforementioned renovation/demolition activity for compliance with the Asbestos NESHAP. Jeremy Lay explained that the Facility was built in 2020 so "asbestos should not be a concern." The EPA inspector explained the 61.145(a) thorough inspection requirement of the Asbestos NESHAP and stated that such inspection was required prior to renovation/demolition activity regardless of the age of the Facility. Jeremy Lay asked what types of building materials could contain asbestos today and inquired as to how contractors were supposed to be aware of the Asbestos NESHAP requirements if the building departments did not tell the contractor about the requirements. The EPA inspector explained the limited ban on asbestos-containing materials. Jeremy Lay stated that he was not aware of when activities began at the site and asked the EPA inspector to contact Dave Roberts (205-240-4406), the project manager, if she had any further questions. Land disturbance was occurring at the time of this inspection with concrete in the parking lot being broken. Conclusion The inspector will follow up with the owners/operators of the facility and the renovation/demolition activity, as deemed appropriate, to obtain information and necessary paperwork related to this activity. This information will include, but not necessarily be limited to, copies of asbestos inspection reports, notifications, and waste shipment records for the facility.
