PLAINTIFF'S EXHIBIT Beyond Safety Regulations BY ROBERT W. WESSON 1 hough many company records, including Union Carbide's, show that employees are safer at work than at home, as long as lives and limbs are being lost in the plant, industry cannot rest on its excellent safety records or regulations. At Union Carbide, improving safety is a goal that everyone is constantly striving to achieve. are rated for their toxicological properties. Much of this work is done at the CarnegieMellon Institute of Research in Pittsburgh, Penna. Union Carbide has long benefited from the services of this toxicology research laboratory. It was nearly 40 years ago that Union Carbide established its Chemical Hygiene Fellowship at the Mellon Institute. This was a full year before the enactment of the Food, Drug and CosmeticAct, which required testing of food additives and other products that might be harmful. 4,000 Compounds Tested During the ensuing four decades, the Fellowship has grown from a two-man opera tion to a staff of over 35. To date, over 4,000 compounds have been assayed to delineate It is a way of life that begins with upper man agement. In addition to a corporate safety department and its committees, each division or operating unit of the Corporation has a safe ty and health organization devoted to its own particular needs. The Chemicals & Plastics people organized a group known as SHARE, which falls under the direction of a vicepresident. The name is derived from safety, health and affairs related to the environment. SHARE further ensures that Union Carbide's Chemicals & Plastics operations meet all aspects of the Federal Occupational Safety and Health Act. Union Carbide is extremely cautious with newly developed chemicals and resins. Before manufacture or use in plants, new substances their toxicological properties. Each chemical is examined to answer the following: Under what conditions can the compound be manufactured without injury to plant per sonnel? Can it be shipped without special han dling procedures? If not, what procedure must be employed? And, under what conditions can it be used safely by the public? Safety programs for the industry .at large are, of course, as vital as the Corporation's internal programs. For example, results of the work done at Carnegie-Mellon by the Chemical Hygiene Fellowship are made available to the scientific community through publication and sharing of information. Product literature rou tinely includes precautionary labeling informa tion, toxicological properties, FDA and EPA status where applicable, and special handling procedures when necessary. Development of MSD Sheets Another advance of which Union Carbide is proud is the development of its Material Safety Data (MSD) Program -- perhaps the largest single endeavor undertaken to provide our cus tomers and our customers' customers with per tinent safety data. In 1970, the Department of Labor mandated that MSD sheets be issued on all hazardous products sold to the ship repairing, ship building and shipbreaking industries (the socalled 3-S industries). These sheets were to be retained at the job site by those using the prod ucts. While safety data have always been published on Union Carbide's products, these new requirements were more detailed and were specific to these three industries. Beyond Government Programs The first Department of Labor MSD regula tion came out on July 1, 1970. Union Carbide meanwhile had outdistanced the government program both in time and in scope. By that time, the company had already devised its own modified MSD sheets -- actually more comprehensive than required -- which the Department of Labor approved on June 20, 1970. Union Carbide's first MSD sheet was issued a few months later. Since that time, over 600 "sheets have been issued covering an enor mous variety of products going into many dif ferent industries. Eventually, an MSD sheet will be issued on every product produced -- even on those not officially considered hazard ous. This program is much too valuable to limit its use to the legal requirements of the man date. When a request is made for a new MSD sheet by customers, distributors or internally, a team of experts, from chemists to lawyers, col laborates on developing a sheet that is as clear and helpful as possible. These sheets are so carefully done -- so comprehensive and clear -- that many other companies,- and even OSHA, use them as models. To gather the physical data, Union Carbide's labs do extensive testing in areas such as haz ardous ingredients, fire and explosion, health, reactivity, spill or leak procedures, special pro tection and special precautions. As a result, much more is included in the data sheets than is required by current OSHA regulations. On each data sheet a list of phone numbers is in cluded so that Union Carbide safety experts can provide assistance at any time, day or night. Not only is a major effort made to prepare the sheets, but also to have them widely distrib uted and used. Customers are encouraged, via direct contact, newsletters, seminars, etc., to ask for the sheets. They can be obtained either through Union Carbide's sales force or distrib utors. Special binders are provided for conve nient filing and efficient retrieval of informa tion. A comprehensive index, which lists all sheets issued to date, is also provided for ready refer ence. Holders of MSD binders automatically receive an updated index as soon as it is issued. And, of course, all MSD sheets are systemat ically reviewed for updating and/or revisions. The MSD Program is only one of many recent efforts to make industry safer. Union Carbide is dedicated to the continued up grading of all safety programs. In the adhesives industry, which is but a single segment of all U.S. industrial activity, OSHA has received a great deal of attention and has been the subject of many hours of discussion and planning within individ ual companies and by industry organizations. Nevertheless, the very scope of the Act has made its comprehension a formidable undertaking for harried manage ment in the average adhesives manufacturing company. The ev eryday concerns of business operations, the many environmental regulations that demand compliance, and a host of hazardous material and consumer safety controls leave little of manage ment's working time for concentration on so broad and allinclusive a subject as the safety of workers in the manufacturing environment. With these considerations in mind, the staff of Adhesives Age has undertaken to provide adhesives management with a working checklist of what is required to achieve compliance with the Occupational Safety and Health Act. In compiling this checklist, we have reviewed the provisions of the Act and have culled out those that most directly apply to such installa tions as may be found in the adhesives industry. The checklist in this fold-out insert is intended to spotlight the most common areas of safety concern for adhesives plants; it is not intended to be a complete digest of the entire Act. We strongly urge company management to obtain complete copies of the OSHA Standards, and to become familiar with them. Perhaps the best way is to secure a subscription to the OSHA Standards service provided by the U.S. Government Print ing Office, Washington, D.C. 20402. The Adhesives Age OSHA compliance checklist has been referenced to provide management with a guide to the sections of the Act that apply to the areas covered. With a copy of the Standards in hand, the plant manager can tell at a glance what safety measures must be taken, and where to find the appropriate regulations. One word of caution: It is impossible to anticipate every man ufacturing situation and every plant feature. Where conditions not covered by the checklist exist, a thorough search of the OSHA Standards must be carried out by plant management, in order to accurately determine specific compliance requirements. V>rim m *-jZSJis SKIP TROWEL Skip Trowel texture is the basic rough texture for walls that is hand applied in a one-coat operation. The material used is joint cement or a manufactured texture with sand added to produce the rough effect. The tex ture shown is a common pattern produced. Variations for special effects can be achieved by changing the amount of texture applied and varying the depth of the pattern. KNOCK DOWN Knock Down is the basic rough texture that is applied with special spray equipment. The material used is a manufactured spray texture. After spray application the texture is knocked down with a clean wide knife to pro duce the desired effect. Variations on this basic result can be achieved with the spray equipment, the amount of material applied, and the hand finishing treatment. SPLATTER Spray gun applied, the material is a manufactured product produced to achieve this texture. The pattern shown in the photo can vary in size and coverage. The specifier should indicate size and depth of the pattern, (i.e., &"). Approximately fifty per cent of the wall area is covered, and this is an acceptable degree of coverage. PRIOR TO TEXTURE 4<?<WS&S8!St6giS^J^V. ,:s , AFTER TEXTURE FOG A fine sprayed-on texture. After the texture is applied, the joint work will still be moderately apparent, how ever, this will not affect the finish painted wall. This texture is a manufactured product designed to achieve a light stipple finish. /' \ V l/m&> BP'7< ORANGE PEEL (Light) :* -V 4 ORANGE PEEL (Heavy) ORANGE PEEL This texture is spray gun applied, with special nozzle and pressure settings to achieve the results shown. Ad ditional depth can be achieved. Specifier should indi cate a light, medium, or heavy texture finish. Samples should be submitted for approval. * \iyyi6>> R'P'T AFTER TEXTURE FOG AND SPLATTER As the name indicates, this texture is a combination of Fog and Splatter. The entire surface of the wall is covered with material-. The ultimate effect, after the walls have been paiiited, is a richer deeper appearance than the Splatter texture. /; * R R p, I ROLLER TEXTURE This texture is applied with a hand roller. The results which are achieved by this method of application gives the viewer the effect of complete coverage of the gyp sum wallboard surface. The degree of texture and coverage are dependent on the amount of material applied and the type of roller used. Kfafrg, 6RS > CEILING TEXTURE (HEAVY FINISH) This texture is used for gypsum wallboard ceilings and is usually specified for residential living and sleep ing areas. Another widespread use is on concrete ceil ings of hotels, motels, and commercial structures. Formulated for ceiling application exclusively, it does not require any additional surface coating. The highlow pattern will vary from one manufacturer s material to another. When a particular pattern is desired, the contractor should be required to supply samples. \<Ljmp0> 6 P - ADDITIONAL COAT OF JOINT CEMENT ADDITIONAL TOUCH UP PLUS SANDING In addition to texture finishes shown in this brochure there are two types of surface preparations which will achieve a smooth wall surface. One is achieved with additional touch up and sanding prior to the applica tion of a proper sealer suitable for additional coatings or wall coverings. This type of finish can also be ob tained with the application of an additional coat of joint cement over the entire surface of the gypsum wallboard. SURFACE PREPARATION: All wallboard joints and nail head or screw depressions should be prepared in order to create the proper foundation for the desired texture prior to application. Concrete surfaces should be cured and be free from dirt, grease, dust, and water soluble materials and any exposed metal properly primed. Projections and offsets must be removed and voids filled flush in order to pro duce the desired results over these concrete surfaces. Preparation of the concrete surfaces shall be prescribed in the scope of work. APPLICATION: Most manufacturers require a limit in the range of air temperature prior to and during ap plication of textures. There are also some time limita tions thatmustbe achieved under slow drying conditions. RESULTS: There are degrees, depths, and surface coverage (all variables) of most of the textures de scribed in this brochure. We believe that your best interests and those of your clients will be achieved when there is a mutual understanding of the texture you desire with those who will be responsible for the prepar ation and application and you are urged to require that samples be furnished for approval.
