As we discussed last week when we met, I wanted to provide you with some additional documents and links to documents that may be helpful in better understanding the issues associated with our licensing efforts for the Loup Power District Hydroelectric facilities (FERC Project No. 1256, Docket No. 1265 031). We feel these documents will help you understand some of the difficulties we see within the licensing process, as well as some of the specific issues that we are dealing with on our project.
The following link takes you to our licensing website http://www.loup.com/relicense/
The documents tab on the left side of the page contains most of the documents relating to the case that have been filed by the parties.
The following link is our January 27, 2017 letter in response to the final BO issued by the USFWS(Nebraska Field Office) http://www.loup.com/relicense/html/documents/LPDComments FBO 20170 127.pdf
The first attachment to this e-mail (2016081-5121(31621704)(1).pdf) is the 08/11/2016 response from USFWS to our 07/11/2016 requesting a meeting after the Final EA was issued by FERC. This is one of the areas where USFWS indicated they could not meet with the District. This document also contains the District's 07/11/2016 letter requesting a meeting.
The second attachment (20150812-5194(30804436).pdf) is an 08/12/15 letter from the USFWS(Nebraska Field Office) to FERC dealing with the revised incidental take statement for the biological opinion.
The following link is the District's 06/01/2015 comments on the USFWS draft BO for the project http://www.loup.com/relicense/html/documents/Comments on Draft BO.p df
The third attachment (20150605-3023(30628649).pdf) is FERC's 06/05/2015 comments on the USFWS draft BO for the project.
The following link is a 12/18/2014 letter from the American Bird Conservancy expressing some concerns associated with the draft EA issued by FERC http://www.loup.com/relicense/html/documents/LABC.141218.Lott ILT Com ments.pdf
The following link is a 01/12/2015 letter from the District to FERC as a supplement to the American Bird Conservancy letter http://www.loup.com/relicense/html/documents/LFERC.150112.Supplement to ABC Comments.pdf
The fourth attachment (1256 10j Comment Response.pdf) is the District's 12/06/2012 response to the DOI's 10/12/2012 Section 10j recommendations.

We thinks these are the major areas that we discussed last week with you that you would want to review. Hopefully, the review will assist you. To the extent we can be of any help, please feel free to contact me or Ms. Nancy Skancke at your convenience and we would be happy to assist you with any questions you may have,
We appreciate the communication and look forward to further discussion.
