The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. There was no other federal, state, or local agency representative present at the time of the inspection. FACILITY DESCRIPTION EPA conducted an inspection at the Novy Oil and Gas Inc., B Lease, where a 3" poly line ruptured, releasing a company estimated 75 barrels of saltwater and .75 barrels of crude oil to the land surface. The spill fluids migrated down a drainage feature into a nearby stock pond. The operator installed a 3" PVC line from the edge of the stock pond to a nearby, temporarily abandoned oil well. At the time of the inspection, the line was not connected to the pond or the oil well. Section II - OBSERVATIONS I observed a temporarily abandoned oil well with a 3" PVC line beginning approximately 3 feet from the well, extending southeast toward the impacted stock pond. See photo No. 1. For additional GPS location information and photo metadata, please see Appendix 1 (photo log) attached to this report. From the well location, looking to the SSE, I observed the PVC line which had been installed between the well and the impacted stock pond. See photo No. 2. I observed the end of the PVC line near the stock pond. At the time of the inspection, the line was not connected to the pond or a pump. There was no evidence the line had been put into service. See photo No. 3. Section III - AREAS OF CONCERN The primary area of concern was the possible use of the temporarily abandoned oil well for underground injection. Additional areas of concern included containment and timely removal of impacted waters from the stock pond to prevent downstream migration of impacted waters into North Bird Creek. 2 Novy Oil and Gas Inc. / Osage B Lease (CWA) Inspection Date 03/19/2025 Section IV - FOLLOW UP EPA inspector contacted Mike Novy with Novy Oil and Gas Inc. via phone call to explain the temporarily abandoned oil well could not be used to inject/dispose brine/oil impacted pond water, only permitted or authorized injection wells are suitable for underground injection. EPA inspector explained the impacted water in the stock pond should be contained and removed to prevent downstream migration into North Bird Creek. EPA inspector will conduct follow-up calls, field meetings and inspections to ensure the impacted area is returned to "pre spill" condition.
