Mercedes Benz, 390- Campinas-SP Caixa Postal 619 CEP 13001-970 Telephone: Sales: (019)225-5022 Adminstration: (019)225-5566 FAX: (019)225-5614 Campinas, December 9,1998 TO: Campinas Regional Office o f the the Ministry of Labor- Sao Paulo State Dr. Ivete Cassiani Furegatti In regard to the remarks made by Engineer Fernanda Giannasi in reference to our decision to suspend the Term o f Notification No. 698/98, we wish to clarify our position as follows: 1) We don't understand how Engineer Fernanda Giannasi finds it possible to claim that our Company has not complied with Annex 12 o f Regulatory Norm 15 [NR-15], because as we already indicated in our appeal dated October 3, 1998- which can be verified "in lo co "- that we have have already complied COMPLETELY with the constant demands o f the Term o f Notification which is being referred to. In regard to the question o f registration with the Regional Labor Office (DRT), this demand, in our opinion, does not apply to our Company because as we already explained in Item 1 of the appeal mentioned above, we are in the metal-working Field and it is easy to verify that none o f the activities specified in item 7 o f Annex 12 o f N R -15 is applicable to our line o f industrial activity. 2) Because o f this, we cannot agree with the assertion by Engineer Fernanda Giannasi that our Company's intention to appeal for the suspension o f Term o f Notification is shameless because--as was already shown above and also in our initial appeal, the Company was already complying with what was being asked for in the Term--which is our reason for a solicitation o f its suspension. Unfortunately there was not time, according to our viewpoint, for Engineer Fernanda to verify these points in detail in our factory, possibly because o f the attention which had to be paid to Mr. Barry Castleman, a North-American specialist who was accompanying the inspection on this day, because we would not have been exchanging so many written communications in regard to a problem (in regard to which a solution had already been found) which led to the Term o f Notification in the first place. 3) Finally, and this is of great inportance to us, we want to refute and 1 of2 2/11/99 8:11 PM TEADIT, trans. o f letter of Dec. 9,1998 mailbox:/c%7C/f/email/Inbox?id=1.5.4.16...449.1f6725d4@mail.mother.com&number=589 protest vehemently against the affirmation by Engineer Fernanda that our Company made ''use o f a trick in order to defraud the law," an assertion which is not in consonance with the truth and which, even worse, having been published in these terms in the major newspapers o f this city, is causing enormous damage to the image of our Company. We end with these clarifications, in the hope of having definitively clarified the queries which were presented. Infelizmente o tempo nSo permita, a nosso ver, a Engenheira Fernanda verificar estes pontos nos detalhes na nossa fabrica, posxdm ente pela atenyo que leve que ser dispensada ao Sr. Barty Castlcman, especialista norte-americano que a estava acomp^bando neste d&C pois no estaramos^ trocando tantas correspondencias sobre \im Tato j solucionado, que deu orgem ao Termo de N otificadlo. 3) Por ltimo, e para nds de maior importanca, queremos refutar e protestar veementementc contra a afirmando da Engenheira Fernanda que a nossa Empresa fez "uso de artificio para fraudar a lci", por ser una afirmavo no condizente com a verdade e pior anda, tendo sido divulgada oestes termos nos principis jom is desta cidade, causando um enorme dao a imagem da nossa Empresa.
