RE: --------
vs. Sherwin-Williams Co.
File No. C327-15881
Dear Lee:
According to my file, we last corresponded regarding the above captioned case in August of 1976. I am enclosing a copy of a medical report which was recently sent
to me by our Personnel Manager at Gibbsboro. This medical report gives us cause for some optimism.
You will recall that the claimants case consisted of an allegation that he had
sustained asbestosis as a result of an exposure to it in his employment at Gibbsboro.
However, the medical records which we have obtained for our file thus far do not
document any diagnosis of asbestosis. Rather, it appears that
does have
extensive lung disease (emphysema) associated with cigarette smoking, and skin
cancer.
If these diagnoses hold up, we are certainly in a much better position as far as the defense of this claim is concerned. According to your last letter Mr. Barton of your Cherry Hill, N. J. office had agreed to keep us advised of any new develop ments in this claim. However, I believe that this medical report is significant and that you should have a copy of it for your file on this claim.
Very truly yours.
