The difference between the pro cedure suggested by them and by you seems very slight and is not particularly flattering to Doctor Hayne. Unless, however, you see some objection to our local counsel's suggestions we will carry them out. I might add that Mr. Herbert is a Columbia lawyer representing our underwriters and he is assiting Benet, Shand &McGowan in the trial of this case. EPjjW Enel. "ear Mr. Dodge; Mr. Herbert and I have very carefully considered the suggestions made in your last letter to the effect that Dr. Hayne request certain informa tion from Dr. Saure and after having received that information that Dr. Hayne go to Washington to confer with Dr. Sayre. Mr. Herbert knows Dr. Hayne extremely well. He used him in a number of mosquito cases some years ago. in connection with a hydro-electric development near Columbia. Mr. Herbert is pretty well convinced that if we asked Dr. Hayne to write to Dr. Sayre requesting information, that Dr. Hayne may or may not write for this information. If he does write for it and it comes to him in the shape of several papers or pamphlets, the chances are he will never read them. Mr. Herbert thinks the best method of procedure is for you to obtain the data from Dr. Sayre's office and send it direct to us. We and Mr. Herbert will then study it, digest it and pick out those portions of it parti cularly applicable to the case in hand and with a summary of the facts in the case as we see them, present this to Dr. Hayne. Mr. Herbert thinks that if this is done Dr. Hayne will become interested and will at once grasp the situation. He thinks that when this has been done Dr. Hayne will probably be very glad to take a trip to Washington to confer with Dr. Sayre. We are strongly inclined to accept Mr. Herbert's judgment in this point, so much so that unless you see some real obstacle, we would request that you procure this data, Or have it sent direct to us and we will then proceed along the lines suggested by Mr.'Herbert.
