July 20, 2000 Diane Brayden OSHA Area Director 3300 Vickery Road N. Syracuse, NY 13212 Dear Ms. Brayden: I am an occupational physician and have had access to medical records of workers from the Garlock packing facility in Palmyra NY through my participation as an expert witness in litigation. I have become aware all of a worker who was exposed to asbestos while working at this facility who subsequently developed mesothelioma. His name is Harland Smith. I enclose a copy of his death certificate. I do not believe Garlock reported this case on their OSHA 200 logs. They were involved in litigation and paid a settlement to Mr. Smith. As a condition of the settlement Mr. Smith agreed not to file a worker compensation claim. I believe that this is generally done so the company can denied that any of its workers suffered work-related diseases and so that the case can be hidden from OSHA. In addition I believe that the Garlock facility is in violation of the monitoring portions of the OSHA asbestos standard. I also believe they have failed to inform workers of the results of abnormal x-rays. I request that you investigate these matters.
