Doyle Vacuum Cleaner Company 225 Stevena Street . . Grand Rapida, Miohigan k9502 . . . 1 ` . ` . Dear Jack: This ia in regard to the Rotunda/Doyle-asbestos dust vacuum oleaner ' project. " The prototype unit model AARE 705-^75 serial number 1027 submitted for 1 fiber emission testing conforms to current OSHA Threshold Limit Values TLV. Our testa also reflect compliance with the two fibers greater than five microns in length per milliliter requirement scheduled for OSHA implementation July 1, 1976. All testa were performed according to OSHA regulations by the University of Cincinnati Medical Center, 3223 Eden Avenue, Cincinnati, Ohio 1+5219- As you requested, we have enclosed a copy of the test data. On the basis of our test, the vacuum cleaner model AARE 705-^75 when properly maintained would be acceptable from a fiber emission standpoint for use in the cleaning of dust from brake or clutch assemblies. However, we . recommend that Doyle continue to test production units on a lot sample basis. Our contact at the University of Cincinnati's Kettering Laboratoryis Dr. Dave Yeager, Assistant Professor Environmental Health, telephone (513) &72-5700. . In regard to the "caution label", Ford Offioe of the General Counsel advises that the heading should read as follows: CAUTION CONTAINS ASBESTOS FIBERS ` AVOID CREATING DUST . BREATHING ASBESTOS DUST MAY CAUSE SERIOUS BODILY HARM ' . A revised label should be provided for review by our Legal Department. ' . 002765 PRODUCED BY FORD / Hr. Jack Doyle June 10, 1575 Pge 2 Ve have reviewed your letter and quotation of May 30, 1975* Ford Motor Company is not in the position to concur with the terms as set forth in the first paragraph of Doyle's proposal under the heading Warranty . Information for Rotunda Vacuum Cleaner Model No. AARE 705^76* Ford Rotunda's standard liability clause would apply. This has been reviewed with our contract attorney, Mr. G. D. Ducharme. He is prepared to further clarify Ford's position and can be reached on telephone (313) 323-0123 In addition, Ford Rotunda's Performance Specification for the vacuum cleaner model AARE 705-1+75 requires that the unit meet all present and future 0SHA standards including the OSHA TLV scheduled for July 1, 1976This requirement should be incorporated in the specifications submitted with your quotation. We hope that we have been of assistance and look forward to your reply. Sincerely, cc G, D. Ducharme O. M. Julien P. J. Keegan W. Rooney S. F. For the past several weeks Stan Svoboda has boon working with Doyle Vacuum Clnnncr Company to establish a warranty for the n A s b e s t o s Dust Vacuum Cleaner. Both our Office of the General Counsel nnd Jack Doyle's legal representatives have been involved. -A copy of the suggested warranty is attached for your review. The summation of their negotiation is that Doyle is suggesting a warranty for tiic bnsie machine with disclaimers against the cnpability of the machine to collect asbestos dust. Gerry Ducharme lias suggested this disclaimer is acceptable based on the fact that we arc forced 1.o accept the University of Cincinnati's test results in absence of ours and Doyles' lack of technical expertise in the area of particle density measurement. At this time we need your approval for the disclaimer warranty in order to finalize the PN. May we have your concurrence to proceed. A. N. Toth, Ford Industrial Hygiene, indicates the need for cautioning technicians against the practice; of blowing the dust from brake assemblies prior to their overhaul. This letter recommends reflecting the use of the new Rotunda Asbestos Dust VacuumCleaner for cleaning these assemblies. Recent developments with our supplier have caused him second thoughts regarding the manufacture of the Asbestos Dust Vacuum Cleaners. This has resulted in an indefinite hold on the availability of an Asbestos Dust Vacuum Cleaner. Further, we are unable at this time to offer any potential availability dates.
