DU PONT DE NEMOURS AND COMPANY'S OBJECTIONS AND RESPONS TO PLAINTIFFS' THIRD SET OF INTERROGATORIES AND ISIXTH1 SET OF REQUESTS FOR PRODUCTION OF DOCUMENTS 2) RECEIVED Pursuant to West Virginia Rules of Civil Procedure 33 and 34, Defendant, E. I. du Pont de Nemours and Company ("DuPont"), by counsel, serves the following objections and responses to Plaintiffs' Third Set of Interrogatories and [Sixth] Set o f Requests for Production of Documents Propounded to DuPont1(collectively, the "Discovery Requests"). I. INTRODUCTION The following responses are made without waiver and with specific reservation of: 1. The right to object to the use of any response, or the subject matter thereof, on any ground in any further proceeding in this action (including any trial of this action) and in any other action; 1The discovery to which DuPont serves these objections and responses constitutes Plaintiffs' sixth set of requests for production of documents, but was erroneously styled Plaintiffs' Third Set of Interrogatories and Fifth Set of Requests for Production of Documents Propounded to DuPont. Plaintiffs served their actual fifth set of requests for production of documents to DuPont on August 13, 2002. CONTAIN NO CBI OOOOll 2. The right to object on any ground at any time to a demand or request for further response (including further interrogatories or requests for production of documents) to these or any other interrogatories or other discovery proceedings involving or relating to the subject matter of the interrogatories responded to herein; and 3. The right at any time to revise, correct, add to, supplement, or clarify any of the responses contained herein. II. GENERAL OBJECTIONS DuPont's responses to Plaintiffs' Discovery Requests are subject to the General Objections set forth below. These General Objections form a part of the response to each and every Discovery Request and are set forth here to avoid duplication and repetition. DuPont's specific responses to each Discovery Request are made subject to, and without waiving, these General Objections. The failure to list a specific General Objection in a response should not be construed as a waiver of that objection. DuPont objects to each Discovery Request on the following grounds: 1. DuPont objects to the Discovery Requests, pursuant to Rule 26(b)(1) of the West Virginia Rules of Civil Procedure, to the extent that they seek to elicit information that is not relevant to the subject matter involved in the pending action and is not reasonably calculated to lead to the discovery of admissible evidence. 2. DuPont objects to the Discovery Requests, pursuant to Rule 26(b)(1) of the West Virginia Rules of Civil Procedure, to the extent that they seek information protected from discovery by the attorney-client privilege, the work product doctrine, or any other privileges or -2 - 000012 immunities from discovery. DuPont declines to respond to the Discovery Requests to the extent that they seek such protected information. 3. DuPont objects to the Discovery Requests, pursuant to Rule 26(b)(1)(A) and (C) of the West Virginia Rules of Civil Procedure, to the extent that they seek information that is obtainable from another source that is more convenient, less burdensome, or less expensive (including, without limitation, through review of documents already produced in discovery), and to the extent that the burden involved in providing responses to the Discovery Requests outweighs the likely benefit of such responses. 4. DuPont objects to the Discovery Requests, pursuant to Rules 33(a) and 34(a) of the West Virginia Rules of Civil Procedure, to the extent that they seek information or documents that do not already exist, or seek information or documents that are not within DuPont's possession, custody, or control. 5. DuPont objects to Plaintiffs' Instructions for Interrogatories, Instructions for Requests for Production, and Definitions to the extent that they exceed, contradict, or attempt to impose an obligation greater than that imposed by the West Virginia Rules of Civil Procedure 6. DuPont objects to the Definitions to the extent that they attempt to give any defined term a meaning contrary to the common and ordinary understanding attributed to the term, on the ground that such Definitions thereby are rendered vague and ambiguous, and thereby would render a response to the Discovery Requests unduly burdensome. 7. DuPont objects to the defined terms "DuPont," "You," "Your," and "Defendant" on the grounds that they are overly broad, vague, ambiguous, and unduly burdensome by virtue of their incorporation of the undefined terms "corporate affiliates," "divisions," "subgroups." "subsidiaries," "parent corporations," "predecessors-in-interest," "successors," "assignees," 3 000013 "partners," and "agents," terms that arguably embody legal conclusions. DuPont further objects to these defined terms on the grounds that they seek information that is not within the possession, custody, or control of DuPont, and seek to impose obligations greater than those imposed by the West Virginia Rules of Civil Procedure. In responding to the Discovery Requests, DuPont construes these terms to refer solely to Defendant E. I. du Pont de Nemours and Company and its current directors, officers, and employees. 8. DuPont objects to the defined term "C-8" as overly broad, vague, and ambiguous by virtue of its use of the undefined terms "manufacturing and degradation byproducts and compounds." In responding to the Discovery Requests, DuPont construes the term to refer to ammonium perfluorooctanoate. III. OBJECTIONS AND RESPONSES TO INTERROGATORIES INTERROGATORY NO. 1: For each C-8, PFO, and/or organic fluorine blood and/or serum test result generated and/or otherwise obtained by or on behalf of DuPont at any time for any current or former employee of DuPont's Washington Works Plant and any non-DuPont employee at any location, identify by name and residential home address at the time of each such test each person tested, the public water service district, if any, in which each such person lived(s) at the time of each such test, and state the length of time each such person(s) resided at each such residential home address(es). OBJECTIONS AND RESPONSE: DuPont objects to this Interrogatory to the extent that it seeks confidential medical and personnel records of DuPont employees or nonDuPont employees. DuPont further objects to this Interrogatory on the ground that it seeks information that is not within the possession, custody, or control of DuPont. DuPont further -4- 000014 objects to this Interrogatory as overly broad and unduly burdensome. DuPont further objects to this Interrogatory as vague and ambiguous. Subject to and without waiving its objections, DuPont responds as follows: Attached hereto as Exhibit A is a chart that includes the following data for each current or former DuPont employee, or contractor, for whom DuPont has such data: the date on which the blood or serum sample was taken; the result of analysis of the sample for C-8; and, if known, the city and state of the person's residential address currently on file with DuPont. The information in Exhibit A is provided subject to the following qualifications: (1) The city and state provided constitute the address of the person currently on file with DuPont, and may not be the address of the employee at the time the particular sample was taken. DuPont does not maintain records that would allow it to provide the address of an employee at the time each test sample was taken. (2) For certain persons for whom no current address is available, "no current address" appears in the address field. (3) For certain persons for whom providing the city portion of the address may breach confidentiality, only the state portion of the address is provided. (4) For certain persons for whom providing any portion of the address may breach confidentiality, "outside of WV or OH" appears in the address field. (5) The analytical methods and best lab practices for determining C-8 level in blood and serum samples, as well as the facilities and personnel conducting the analysis, have changed and evolved over the time period represented by the data provided in Exhibit A. -5- 000015 (6) An address in a town serviced by a public water district does not necessarily mean that the person was a customer of that water district. DuPont does not possess any records that would provide such information. IV. OBJECTIONS AND RESPONSES TO REQUESTS FOR PRODUCTION OF DOCUMENTS REQUEST NO. 1: All documents relating or referring to any and all medical condition(s) of each person for whom data is requested in Interrogatory No. 1 above, including but not limited to any and all adverse health effects experienced or claimed by each such person, including but not limited to, all documents used or relied upon by DuPont to support the statements set forth in its March 7, 2003, press release to the media that "data from our own employees who live in the community but do not work near C8 confirms that people in the community have levels of C8 in their blood significantly lower than employees who are actually exposed to C8 in the work place" and that DuPont has "factual data that indicate that the highest blood levels are in DuPont employees who work in the C-8 area, and we know that there have been no adverse health effects seen in those employees". OBJECTIONS AND RESPONSE: DuPont objects to this Request on the ground that a portion of the documents requested comprise confidential medical and/or personnel records of current and former DuPont employees. It is not possible to redact or otherwise partially produce the records in such a fashion as to preserve their confidentiality. DuPont further objects to this Request to the extent that it seeks documents previously produced by DuPont to Plaintiffs. DuPont also objects to this Request on the ground that it is vague and ambiguous and further states that the portion of the quotation "factual data that indicate that the highest blood levels are in DuPont employees who work in the C-8 area, and we know that there have -6- 000016 been no adverse health effects seen in those employees" references adverse health effects attributable to C-8. Subject to and without waiving its objection, attached hereto as Exhibit B is one redacted document which contains some data that was used by or relied on, in part, by DuPont to support the statements set forth in its March 7, 2003, press release to the media that "data from our own employees who live in the community but do not work near C8 confirms that people in the community have levels of C8 in their blood significantly lower than employees who are actually exposed to C8 in the work place". Because DuPont possess no additional documents beyond those previously produced or those confidential medical or personnel records to which DuPont objects to production, at this time, DuPont is producing no additional documents responsive to this request. REQUEST NO. 2: All documents used, relied upon, or referred to in connection with or otherwise relating to preparation of your response to the Interrogatory set forth above. OBJECTIONS AND RESPONSE: DuPont objects to this Request on the ground that a portion of the documents requested comprise confidential medical and/or personnel records of current and former DuPont employees.
