Per our discussions, I am attaching the quarterly lobbying reports I have filed for the last seven quarters in my role as a registered lobbyist for Newmont Mining Corporation. I can provide reports going further back if you need them. The clients whom I have assisted on environmental matters in recent years are: 1. Newmont Mining Corporation: I have assisted or am currently assisting Newmont in preparing comments on EPA's proposed Definition of Solid Waste Rule under RCRA, EPA's and the Corps' proposed WOTUS rule, and EPA's proposed financial responsibility rule for hardrock mining companies under section 108(b) of CERCLA. I have met with officials from EPA (both HQ personnel and Region 9 personnel) and OMB in connection with each of these rulemakings. I also represented Newmont in a 7-year dispute with EPA relating to management of mercury-bearing wastes at Newmont's Gold Quarry mine. That dispute resolved over a year ago. I have also represented Newmont before the Congress in connection with inserting provisions dealing with mercury management in the TSCA amendments that became law a year or so ago and in connection with proposed Good Samaritan legislation for mining companies (i.e., legislation to relieve mining companies of certain environmental liabilities and permit requirements if they voluntarily agree to clean up a site with which they had no prior involvement), and proposed Mining Law reform legislation. I perform periodic audits of all Newmont mining facilities and advise day to day on environmental compliance issues. 2. National Mining Association: I drafted briefs and argued on behalf of NMA in the Idaho Conservation League case, in which the DC Circuit ultimately approved a settlement between NGOs and EPA that required EPA to propose a rule under CERCLA 108(b) for the hardrock 17cv1906 Sierra Club v. EPA - 6/22 Production ED 001523 00003077-00001 mining industry by 12/1/16 and to take final action on the proposal by 12/1/17. I also prepared an amicus brief for the NMA in Perez v. Mortgage Bankers Association (USSCt) dealing with issues of administrative law, and an amicus brief for NMA and several other trade organizations in Pakootas v. Tech Cominco (9th Circuit) dealing with whether industrial air emissions can trigger CERCLA liability. 3. Mitsubishi Corporation: I represented Mitsubishi in connection with NRD claims brought by the Department of the Interior and the New Mexico NRD Trustee relating to the Chino Mine in New Mexico, in which Mitsubishi formerly held a minority interest. 4. Nevada Mining Association: I have been assisting the NvMA in connection with its preparation of comments on EPA's financial responsibility proposal under section 108(b) of CERCLA.
