We are unable to quote prices for 1:1 scale drawings as you requested. Our original drawings are reduced scale, usually on 8-1/2 x 11 originals. We are therefore, to speed up this request, providing you with reduced scale drawings (all 8-1/2 x 11) for the prints requested. We had a few problems. We have no clutch facing print 836. We there fore are sending 836A. Where you requested PADS (With and without its back metallic-shields) we are sending you what we have. These are the lining numbers 728A, 778, etc., and then the steel shoe prints, such as D-52-I, D-52-0 , D-38, etc. Some of the steel shoe prints do not have dimensions. When these were supplied to us, the shoe manufacturer removed dimensions, and the print was provided for "identification" only. Earlier this month Dur-Bloc's General Manager, Mr. Marcos Ludmir Wolfenzon, was in the United States and inquired about Regional Membership, Soon there after 1 received the Dur-Bloc, S.A. application. According to Mr, Ludmir Vi/,, Dur-Bloc manufactures friction materials in Peru, and has sales of about $2,000,000 of friction materials. In addition to this manufacturing activity, Dur-Bloc, S.A. imports and distributes in Peru auto motive products manufactured elsewhere. He mentioned Federal-Mogul and Wagner Electric in the United States as suppliers. Mr. Ludmir W. indicated that Dur-Bloc, S.A. plans exporting disc brake linings internationally including the United States. I advised that to do so using the copyrighted FMS1 numbers and the FMS and FMSI trademarks that Dur-Bloc would be assessed the same annual fee schedule that Active Members pay, and for one category (brake linings) this would be $1,700 per year. The Dur-Bloc application was received with the prepayment of the first year annual dues. The application, upon receipt, was sent to the Membership Committee for its review. If its acceptance is recommended by the Committee, the Board of Directors and finally the Membership will review and vote on this application. As I indicated, brake linings sold in most states in the United States must be certified as having met the requirements of Vehicle Equipment Safety Commission (VESC) Regulation V-3, copy enclosed. This is ordinarily done by applying for certification: American Association of Motor Vehicle Administrators 1201 Connecticut Ave., N.W. Suite 910 Washington, D.C. 20036 (AAMVA) In order to gain approval, a manufacturer must have his linings tested by an independent testing laboratory. I have enclosed a list of testing laboratories qualified to run these tests. You should contact one of these labs for procedures and costs. As you indicate your company is a Peru manufacturer of friction materials, they may be eligible for Regional Membership in the Institute. This fee is established for manufacturers of brake linings and clutch facings outside of the United StateB who are entitled to rights and privileges in use of the copyrighted FMSI numbers for foreign distribution, but not for use of the United States Copyright and Trademark for distribution in the United States. FMS and FMSI are registered trademarks of the Friction Materials Standards Institute, Inc. The regular Regional Member would be entitled to receive all engineering and technological data gathered by the Institute, but not the sales statistics (unit sales of friction materials sold in the U.S.A.). REGIONAL MEMBERS WITH U.S. COPYRIGHT AND TRADEMARK PRIVILEGES Since some Regional Members wish to use our copyrighted catalogs and the copyrighted and trademarked FMSI numbers on their literature and on their products being exported to the United States, for all intents and purposes they have all the rights of a domestic manufacturer. For this reason. Regional Members using the FMSI numbers for exporting to the United States pay the same fee that the United States manufacturers pay. While a member could pay $3,650 (for four categories: Brake Linings, Brake Blocks, Clutch Facings, and New Un-lined Brake Shoes) you indicated that your manufacturer was interested in marketing disc brake linings only in the United States. This could be one category (Brake Linings) and the annual fee would be U.S. $1,700. As I indicated these are the current annual fees, and they could be changed in the future. APPLICATION I am enclosing the following: 1 copy - - Constitution and By-Laws 2 copies - Application Forms To apply, you should complete the Application Form in English, and forward it to the Institute with a check for $1,300 in U.S. Dollars. If accepted the $1,300 is applied to the first year dues. If not accepted, the Institute returns the $1,300. The application must be signed by a responsible officer of the manufacturer. SERVICES TO MEMBERS The Constitution and By-Laws as well as the booklets help explain activities of the Institute. However, I will try to be more specific concerning the services of the Institute. The Friction Materials Standards Institute publishes bulletins and catalogs concerning brake linings and clutch facings used primarily on over-the-road vehicles. The members feel that by having the Institute publish catalogs at much greater volume, they are able to save substantially on their catalog cost. If there are questions concerning new releases, the Institute tries to answer the member with the best information available. Bulletins are mailed to members as soon as information is available on new releases by the vehicle manufacturers. In addition prints are available from the Institute Office to members at $.75 per print. For orders of one or two prints, there is no charge. We attempt to provide our members with the latest information on brake lining requirements by the various States, and to provide information on new regulatory standards, new SAE test procedures, etc. A primary reason for Membership had been that our FMSI Numbers and the Nuinbering System are copyrighted and FMS and FMSI are registered trademarks. Use of these FMSI Numbers in catalogs, price sheets, packaging, etc. by non-members is in violation of our Copyrights and infringes on our Trademarks. A manufacturer who is a member is permitted full use of the copyrighted numbers and the trademarks we may permit his customers to use them. The Institute also represents the brake lining manufacturers and clutch facings manufacturers with the Asbestos Information Association of North America. The Institute coordinated a response that was made to the Illinois Pollution Control Board which intended to prohibit the use of asbestos in brake linings sold in the State of Illinois. We presented the Industry viewpoint on asbestos in the work place when the Occupational Safety and Health Administration (OSHA) proposed stringent new exposure levels for asbestos. Our Asbestos Study Committee has given input to the Asbestos Information Association as regards asbestos.problems in the friction materials business. We also have passed information on to our membership concerning the latest OSHA and EPA regulations as concerns asbestos. The former Chairman of our Asbestos Study Committee was one of the industry representatives on the Advisory Board that debated the asbestos regulations before they were issued. The Institute maintains a Brake Performance Study Committee which, when the original New York State Brake Lining Law was being written, helped draft a law that was reasonable to both industry and the public. We have consulted with the Vehicle Equipment Safety Commission when revisions were planned in the V-3 procedure. We have been in contact with AAMVA concerning their certification requirements for brake lining and worked out a compromise with them on "grandfathering" existing brake lining certifications. We attempt to keep the industry posted on the progress of the various regulatory authorities as regards brake linings. In addition, we maintain close liaison with NHTSA as concerns Federal standards on brake lining and brake systems. We have given input to the NHTSA as regards Standard 105-75 (Hydraulic Brake Systems) and Standard 121 (Air Brake Systems). Mr. Ludmir W. (Full name: Marcos Ludmir Wofenzon) was in the United States and had called me on this subject. Our original reply to Mr. Ludmir W. was addressed to his attention at Duromotive Industries, Inc., in Brooklyn, N. Y. According to Mr. Ludmir W., Dur-Bloc manufactures friction materials in Peru, and has sales of about $2,000,000 of friction materials. In addition to this manufacturing activity, Dur-Bloc, S.A. imports and distributes in Peru auto motive products manufactured elsewhere. He mentioned Federal-Mogul and Wagner Electric in the United States as suppliers. Mr. Ludmir W. indicated that Dur-Bloc, S.A. plans exporting disc brake linings internationally including the United States. I advised that to do so using the copyrighted FMSI numbers and the FMS and FMSI trademarks thatDur-Bloc would be assessed the same annual fee schedule that Active Members pay, and for one category (brake linings) this would be $1,700 per year. I have now received an application from Dur-Bloc, S.A. The application was received with pre-payment of the one year dues. Their application is apparently in order, and a copy is attached.
