The D.C. Circuit Court of Appeals today set speedy deadlines for responses to EPA's request to delay implementing its methane rule for future oil and gas wells, indicating a decision on the matter could come as soon as Wednesday.
On Friday, EPA asked the court to delay its July 3 order for EPA to resume enforcing the Obamaera methane rule, arguing that the agency was not given proper time to consider seeking a re hearing.
Today, the three-judge panel ordered environmental groups to file their response by noon on Tuesday, with EPA's reply to that due by 10 a.m. Wednesday.
WHAT'S NEXT: The condensed timeline indicates the court will move on EPA's request quickly, possibly as early as Wednesday. EPA is separately working to establish a two-year delay, but that effort likely will not be in place until September.
