Based on the advice of Canadian counsel as to the actual responsibilities of an agent we have arranged for an agent's service through CT Corporation. This action should allow us to proceed with the sale of any products classified as dangerous goods in Canada. It has been confirmed that Transport Canada will allow both northbound and southbound transborder shipments to continue under 49 CFR (DOT) until October 31, except for Class 1 materials (explosives). However, still in effect as of July 1, the requirements are to include an emergency response plan number on the shipping paper for any shipment of a commodity in schedule 12 of the regulations together with the telephone number required to activate the plan. The information above must be furnished by the Canadian shipper or importer or by the U.S. shippers agent if that agent has an emergency response plan on file with the agency. At this time our agent will not have a plan, therefore we need to obtain the emergency response plan number and telephone number for plan activation from our Canadian customers who buy dangerous goods. I can contact those customers if necessary. Please let me know if I should do this or the TSR's should do it. Also, we need to assure any Canadian shipment is reviewed for additional paperwork, or other, requirements. I am getting mixed signals as to what is or might be shipped to Canada that is affected by the regulations. I need input from the business area on this issue. Before October 31 we need to work with all affected Canadian customers to assure the other requirements (retroreflective placards, etc.) are met to their satisfaction.
