Dear Messrs. Thorndal and Alverson:
I am writing to you in hopes that we can stipulate to exceeding the customary limit on the number of interrogatories to be propounded by each party of an action. As I am sure you are aware, Local Rule 190-- 1(c)1 states that the total number of interrogatories allowed by each party is 40. However, due to the particular facts of this case, we believe that open and effective written discovery methods will help clarify the issues involved in this matter, thereby minimizing the time required for trial. In that regard, we believe that good cause exists in this case to warrant going beyond the customary limit. I assure you, though, that if this Stipulation is entered into, we will take particular care to tailor our inquiries to the heart of this case, rather than propounding meaningless, make--work questions of little substantive importance.
1 (c) Limitation of Interrogatories Unless otherwise ordered by the court, the total number of interrogatories propounded to each by party by any other party pursuant to Fed.R.Civ.P. 33, shall be limited to 40 including subparts. The interrogatories shall be tailored to the needs of the particular case. Failure to comply with the provisions of this Rule will justify the imposition of sanctions. L.R. 190-1 (c).
