Subjact MATERIAL SAFETY DATA SHEETS FOR CHOCOLATE BAYOU PRODUCTS
We have now completed Material Safety Data Sheets (MSDS's) for our Bayou products. In preparing these sheets it became obvious that in many instances our MSDS's contain significantly different information than Monsanto's MSDS's for the same product. In my conversations with the Monsanto personnel this appeared not to be a concern.
However, after discussing this issue with our legal staff some real concerns do arise. Basically, if a consumer were to use a product from the Bayou based on out of date or incomplete information on a Monsanto MSDS and sustain "injury" or violate regulations based on out of date information, the consumer could bring suit against the joint venture, which would of course include Conoco Chemicals.
A good example of the type of discrepancies that exist is seen with the MSDS on Benzene. Monsanto's sheet has an exposure limit of 25 ppm. The current federal standard has been 10 ppm for many years. Our sheet does have 10 ppm as the exposure limit.
Also, as we have discussed, Monsanto's reluctance to supply us with the studies from which they obtained toxicological information on many of the Bayou products is distressing. We have used the information they supplied us on our MSDS's and need documentation of the data for our files.
Please advise as to what you feel would be the best course of action to take on this issue.

Following are responses to the items in the subject request. Also, where applicable documents are enclosed. These responses are based on our understanding and interpretation of the scope of the questions.
1. Enclosed are Conoco Chemicals MSDS's prepared solely by the company. No such document or information was prepared in conjunc tion with CMA.
2. No safety guides of the CMA were found, nor do we h$vft>know1edge of such documents.
3. Conoco does not have on file the publications(s) Guidelines for Risk Evaluation and Loss Prevention in Chemical Plants.
4. Conoco does not have on file the publication. Index of Case Histories
of Accidents in the Chemical Industry.

5. To the best of our knowledge there was no Chemical Safety Data Sheet
published by CMA on PVC, PVC compounds and resins or PVC materials
and products.

6. Enclosed is a bibliography list of technical/scientific publications by Conoco personnel concerning PVC, PVC compounds and resins and PVC materials and products.
As mentioned these responses are based on our understanding of the questions and a reasonable search of files and records.
