See the attached letter from a number of trades to Acting CFPB Director Vought. We are concerned that allowing the two NPRMs: (1) Protecting Americans From Harmful Data Broker Practices; and (2) Identity Theft and Coerced Debt to stay on as live dockets will allow the Warren allied groups to continue to submit a large number of comments. This could result in a future administration reopening these rulemakings, even if they are never finalized, and have an extensive record to justify issuing these rules. As detailed in the letter these rules stretch the legal authority of CFPB under the Fair Credit Reporting Act.
The best course of action is to pull these down ASAP to take the dockets offline and prevent these groups from continuing the astroturf campaign. Happy to provide more info if you'd like. If you could help in any way it would be much appreciated.
