F-nom th.e occupational history that I obtained on March 13, 1992 , he told he wa* expoted to various chemical* and I dedaeed that tome 06 tfuete may have been, u/lthln probability, carcinogen*. In 4act, I mentioned In my report of June 30, 1992 that he Mat expoted to 6enzene like chemical* at watt at other organic chemical* and that there l* a po**lblllty that an anemia, which he Informed me about, might po**lbly be related to a malignancy. I Informed you that considering the occupational hl*tory, thl* anemia *hould be counted at pant of hi* occupational Injuria*. A nepont from the Ettex Oncology Group dl*clo*e* that the patient ha* the myeJtody*pla*tlc *yndrome. Or. Burke In hi* oncology report to Dr. Jame* Or*lnl, which I reviewed, took an occupational history and he also learned that Mr. wot expoted to high concentration* of both lead and benzene. Dr. Gregory I. Burke provide* Information about an experimental drug therapy that the patient will undergo. I reviewed a copy of a letter by Dr. Jame* M. Or*lnl dated July 30, 1992 *tatlng that Mr. n *uffer* from a myelody*pla*tlc *yndrome, type 2. He al*o relate* In thl* letter the occupational history that he had multiple expo*ure* to benzene and thl* l* within certainty the etiology of hi* hematological problem. He now l* tran*fu*lon dependent. 0007-SWP-005803065 CONFIDENTIAL REDACTED Sam Freeman., E-Aq. 2- - September 17, 1993 Rt: < Benzene, is a well known chemical, very common one, -in the, workplace, which cause* bone marrow toxicitie* and symptom* of various types. The, myelodysplastic syndrome happen* to 6a one of these. There are also concomitant, condition* that can at*o ocean related to hi* pee*ent anemia, namely acute myelogenou* leukemia. Benzene exposure can caune bone marrow failure, aplastic anemia*, and leukemia*. Fortified now with thi* definitive information about the hazandou* *ub*tance hk wa* exposed to, namely benzene, and the e*tabli*hment S~*\of n definitive hematological abnormality, namely the "'\\myelodysplastic *yndnome, I am able to render a conclusion relative uJto thi* occupational injury. Ba*ed upon the history and the finding* and a neview of medical necond* fnom treating phy*ician*, flit i* my opinion that Hr. ha* a bone marrow Jabnormality, myelody*pla*tic *yndrome, for which I would estimate a disability of 100 percent of total. It i* my opinion within the realm of medical probability that hi* exposure to chemical*, \e*pecially benzene or po**ibly other benzene derivative* in hi* employment at Sherwin William* Company provided a *ignifleant exposure to induce hi* hematological abnormality. There i* a direct causal relationship between hi* exposure in the workplace to benzene and hi* present bone marrow condition. Vz/ The myelody*plastic *yndrome i* known, to evolve into other hematological condition*, *uch as acute leukemia. Thi* is a Id ]Ipossibility for the near future. However, the myelody*pla*tic syndrome in itself is a fatal condition and in my opinion, it would 6a, wise to take hi* Depo*ition in order to preserve his testimony. II I want to brine to your attention that two examination* have been LI performed on L already alluded to; October 25, 7 985 with report dated December 3, 7 98 5 and a repeat examination February 1, W/7999 with a report dated March 13, 1990. Thi* report is an addendum VJ/report related to my finding* mentioned in the February 13, 1990 \ /report. Hr. wa* also examined in my office a third time on | ,1 Harch 13, 1992 and a report was sent to you dated June 30 1992. || Thus, according to my calculations thi* will now be the fourth M report regarding this matter.
