Twin Falls, Idaho 83301 Pursuant to Section 6(e)(1) of the Toxic Substances Control Act, (Public Law 94-469), regulations were promulgated in Title 40 of the Code of Federal Regulations, Part 761 (43 Federal Register, 7150 et seq.) setting forth the requirements for the formal approval of chemical waste landfills for the disposal of polychlorinated biphenyls (PCBs). By letter dated March 27, 1978, Wes-Con, Inc. made an application to the EPA Region X for approval of a chemical waste landfill for PCB disposal (Wes-Con "B" site) which is located in W*s of the NE% and E*s of the Eh of the NWIs of Section 19, T.4S., R.2E.B.M., Owyhee County, Idaho. The company submitted a technical report as required by Section 761.41(c)(1) and (2). Public notice of the application was published on May 1, 1978 in the "Idaho Statesman" in Boise and the "The Mountain Home News" in Mountain Home and on May 4 in the "Owyhee Chronicle" in Homedale and the "Owyhee Nugget" in Marsing. A copy of the notice was also posted in the United States Post Office at Grand View, Idaho. No comments were received regarding PCB disposal. In a letter dated March 30, 1978 to EPA Region X, Idaho's Department of Health and Welfare agreed to certify the Wes-Con "B" site and submitted a technical evaluation report on May 8, 1978, endorsing approval of WesCon "B" site for disposal of approved types of polychlorinated biphenyls. EPA Region X has reviewed the State of Idaho's technical evaluation report and all other supporting information that was submitted. In addition, a site visit and evaluation was made on May 22, 1978. EPA Region X concurs with the conclusions in the State of Idaho's technical evaluation report. On the basis of this report together with 0481076 2 the other supporting information that was submitted and subject to the requirements and conditions of Parts A and C of the enclosed Technical and Operational Requirements, approval is hereby granted for PCB waste disposal for the Wes-Con, Inc. disposal site located in of the NE^s and Zh of the Zh of the NW>s of Section 19, T.4S., R.2E.B.M., Owyhee County, Idaho.
