This litigation is currently being held in abeyance at the D.C. Circuit based on the agreement of EPA and petitioners and without the objection of intervenors. I represent the Pellet Fuels Institute (PFI); PFI separately challenged EPA's final standards for pellet fuel on the basis that they exceed the Agency's statutory authority under CAA section 111, are arbitrary and capricious and lack a sufficient administrative record. Since the current abeyance only extends until June, it would be helpful to discuss how we might be able to engage the Agency on this matter. I am available by phone or in person to discuss this matter; whatever works on your end.
