Yates (Facility) is a Tribally-owned gas station and convenience store located on the Standing Rock Reservation in Fort Yates, North Dakota. The Standing Rock Sioux Tribe took ownership of the Facility, formerly called Tim's Service, in April 2022. The fuel at this Facility is sold to the public. The Environmental Protection Agency's (EPA) Facility records indicate that the Facility has three single-walled, fiberglass reinforced plastic (FRP) underground storage tanks (UST), which were installed in 1992. Tank 1 is 8,000 gallons and contains unleaded gasoline. Tank 2 is 6,000 gallons and contains unleaded gasoline. Tank 3 is 2,000 gallons and contains diesel fuel. Facility piping is doublewalled FRP and operates with safe suction. Inspection Narrative On September 26, 2023, the EPA UST program personnel conducted an inspection at Rock Energy Ft. Yates in Fort Yates, North Dakota. The EPA last inspected the Facility on November 4, 2020, and they selected it for routine re-inspection. Ms. Grabowski spoke with Facility representatives, on September 11, 2023, to schedule the inspection. She also sent a follow-up email (see Attachment A). 3040001-Rock Energy Ft. Yates Page 1 of 3 9/26/2023 UST Inspection The EPA inspection team arrived at the Facility at 8:05 a.m. CDT. They were met by the Facility representatives. Ms. Grabowski introduced herself and presented her inspector credentials. Ms. Grabowski filled out a Notice of Inspection (NOI) (see Attachment B) and she requested a signature. Ms. Grabowski explained that the NOI serves as documentation of consent for the EPA to conduct an inspection. In addition, she said that she would provide the NOI to the Facility at the end of the inspection. EPA inspectors conducted a physical inspection of the UST system as well as a review of Facility records. Photographs of UST system components taken during the inspection are in Attachment C. Copies of operation and maintenance records are in Attachment D. Tank Leak Detection Tank leak detection is conducted by an OPW EECO 1500 automatic tank gauge (ATG), which performs static, 0.2 gallon per hour (gph) tests. At the time of the inspection, the Facility representative provided 3 months (July-September 2023) of passing tests, as documented on monthly walkthrough checklists. The Facility representative stated that the ATG console printer was not functioning since approximately July 2022. Documentation of annual operability testing of the ATG system was not provided during the inspection; however, the test was conducted later that day, and passing results were emailed to the EPA inspector. After the EPA inspection, the Facility representative provided photographs (of the ATG console) via email showing passing leak tests for each tank in September 2023 and October 2023 (see Attachment D). Piping Leak Detection No release detection is required as the Facility piping operates with a safe suction system. Cathodic Protection Cathodic protection (CP) is not required at this Facility as the tanks and piping are constructed with non-corrosive material. Periodic Testing/Inspection of Spill and Overfill Prevention Equipment The Facility representative was not able to provide records of spill bucket testing and overfill prevention device testing at the time of the inspection. According to EPA records, spill buckets were hydrostatically tested and passed on February 1, 2021, and overfill prevention devices (flapper valves) were installed in approximately April 2021. Periodic Operation & Maintenance (O&M) Walkthrough Inspections Records of monthly walkthrough inspections from January 2023-September 2023 were maintained at the Facility. No annual walkthrough inspections were provided at the time of inspection. Operator Training Proof of operator training was not provided at the time of the inspection; however, the Facility representative emailed Class A, Class B, and Class C operator training documentation to EPA on October 9 and 11, 2023. 3040001-Rock Energy Ft. Yates Page 2 of 3 9/26/2023 UST Inspection Financial Responsibility The Facility uses the North Dakota DEQ Petroleum Tank Release Compensation Fund (fund). The EPA observed a certificate of registration (Number 230) for the fund onsite, which expires on July 31, 2024. Physical Observations The inspection team viewed the spill buckets/fill pipes, dispensers, one ATG riser and the ATG console. Spill buckets for all tanks were clean and dry, and each fill pipe was equipped with a flapper valve. The ATG console had a yellow light illuminated, indicating "trouble." The yellow light may be associated with the lack of printer functionality at the time of inspection. Inspection Conclusions and Recommendations At the end of the inspection, Ms. Grabowski filled out an Onsite Deficiency Identification Form (see Attachment E), which represents the EPA staff's initial compliance recommendations at the time of the inspection. Prior to departing the Facility, Ms. Grabowski stated that a full inspection report would be forthcoming, which includes the inspection checklist (see Attachment F). Ms. Grabowski provided the Facility representative with the NOI form and the deficiency form and retained carbon copies of both forms for recordkeeping. Inspection Report Attachments A.
