The Council is expected to meet later this summer for the purpose of reviewing a plan for basic research to be conducted under the authorities of the Superfund Amendments and Reauthorization Act of 1986. In the course of this meeting your views will be solicited on how best to coordinate research programs supported by the Superfund program and conducted by various Federal agencies. In subsequent years we plan to convene the Council once each year for a two day period to review the results of research studies conducted by university-based grantees and to ash your assistance in assuring that research findings be given the widest distribution and application to the immediate problems created by uncontrolled hazardous substances. Enclosed is a copy of the Charter which describes the structure and functions of this Council. O.C. 20201 CHARTER Advisory Council on Hazardous Substances Research and Training PURPOSE The Secretary of Health and Human Services is required under Section 311(a)(5) of the Comprehensive Environmental Response, Compensation, and liability Act of 1980, Public law 96-510, as amended, by the Superfund Amendments and Reauthorization Act of 1986, Public Law 99-499, to establish and support a hazardous substances research and training program. The Advisory Council on Hazardous Substances Research and Training shall advise, assist, and consult with, the Secretary; the Assistant Secretary for Health; the Director, National Institutes of Health; and the Director of the National Institute of Environmental Health Sciences on the implemen tation and coordination of Section 311 and shall be available to consult and coordinate with the Department of Defense regarding other programs of research, demonstration and training established and funded under Chapter 160, Section 2702 of Title 10 U.S. Code. AUTHORITY Section 311(a)(5) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, Public Law 96-510, as amended, by the Superfund Amendments and Reauthorization Act of 1986, Public Law 99-499. The Council is governed by the provisions of Public Law 92-463 as amended (5 U.S. Code, Appendix 2), which sets forth standards for the formation and use of advisory committees. FUNCTION The Council shall advise the Secretary; the Assistant Secretary for .Health; the Director, National.Institutes of Health; and the Director of th&' National Institute of Environmental Health Sciences on implementation of Section 311(a) of the Act, and assist In the coordination of this sub section and other programs of research, demonstration and training under Sections 311 which are conducted or administered by the Environmental Protection Agency. The Council shall review the plan prepared by the Director of the National Institute of Environmental Health Sciences pursuant to Section 311(a)(6). The Council shall also review the report prepared by the Environmental Protection Agency pursuant to Section 311(e); consult with the Department of Defense pursuant to Chapter 10, Section 2702 of Title 10 U.S. Code, as amended by Section 211 of Public Law 99-499. The Council may request reports on other research, demonstration and training activities authorized and funded under other provisions of the Act. APOO( rt ;* STRUCTURE The Council shall consist of 26 members including the Director, National Institutes of Health; the Director of the National Institute of Environmental Health Sciences, as Chair; the Assistant Administrator of the Environmental Protection Agency for Research and Development; the Assistant Administrator of the Environmental Protection Agency for Solid Waste and Environmental Response; the Director of the Office of Technology Demonstration established under Section 311(b)(2); the Assistant Secretary for Environment, Safety and Health, Department of Energy; the Assistant Secretary of Labor for Occupational Safety and Health; the Assistant Secretary of Defense for Health Affairs; the Associate Administrator of the Agency for Toxic Substances and Disease Registry; the Director of the Center for Environmental Health; the Director of the National Institute for Occupational Safety and Health; two representatives of the chemical ^> industry; two representatives of entities engaged in the management of toxic wastes; three representatives of Institutions of higher education, r representing the fields of biomedical sciences, medicine, and engineering; two representatives of State and local health and environmental agencies; two representatives of organized labor; two representatives of national environmental groups; and two representatives of the general public. Membership on other advisory councils or similar bodies shall not preclude representation on this Council. Members shall be invited to serve for the duration of the committee. The Council may establish subcommittees from among its members and the Council and its subcommittees may call on ad hoc advisors fdr the purpose of providing \ technical expertise and advice in discrete areas related to the mandate of the 1 Council. Management and support services shall be provided by the Office of the Director, National Institute of Environmental Health Sciences. MEETINGS l Meetings of the full committee shall be held approximately once ajyear, at the 1 call of the Chair, Meetings of subcommittees may be held approximately 1 three times a year at the call of the Chair. A government official shall | approve the agendas and shall be present at all meetings of the full committee and the subcommittees. Meetings shall be open to the public except as determined otherwise by the Secretary; notice of all meetings shall be given to the public.
