Customs and Border Protection utilizes this facility to store and process shipments coming into the country through the Port of Boston. RK Wing, Corp., doing business as Rossini's Pizzeria & Restaurant, located at 206 Fitchburg Turnpike Concord, MA, is a restaurant that serves pizza, pasta, and salad. Potentially Applicable Federal Air Regulations: The following federal air regulations may be applicable to the Facility: Clean Air Act Title II - 40 CFR Part 1039 Control of Emissions from New and In-Use Non-Road Compression-Ignition Engines Previous Enforcement Actions: A "Detailed Facility Report" from EPA's Enforcement and Compliance History Online database indicates that there have been no informal or formal enforcement actions taken against RK Wing, Corp. with respect to this facility in the past five years. Pre-Inspection Timeline On December 19, 2024, Officer William "Bill" Troup of Customs and Border Protection ("CBP") emailed EPA inspector Davianna Vasconcelos photos and import documentation for Entry Number 16506180021 inquiring about labels on two excavators. II. Inspection The inspection was coordinated with Officer Troup in advance. Page 2 of 3 EPA inspectors Davianna Vasconcelos and Darren Fortescue arrived at the facility at approximately 10:45 a.m. and signed in at the front window. EPA inspectors met Officer Troup and followed him to his office. EPA inspectors presented their credentials to Office Troup. Officer Troup led EPA Inspectors to Bay Door Number 11 to Container Number FCIU9118070. EPA Inspectors inspected one excavator. EPA Inspectors found one label on the engine which Ms. Vasconcelos noted was lifting at the corners. Ms. Vasconcelos took notes. See Attachment A. Ms. Vasconcelos and Mr. Fortescue took photos. EPA Inspectors could not inspect the second excavator due to space restraints and safety concerns. Officer Troup led EPA Inspectors back to his office and the group discussed potential next steps, including EPA drafting a Letter of Recommendation for Denial of Entry.
