Jayson Foley, Idaho Department of Environmental Quality (IDEQ) Wastewater Enforcement Coordinator, met me at the G&S Excavation's office to act as an observer. When we arrived, there was no one available to talk to except a maintenance worker so I called Tom Giannini, the Owner and Permit holder. I told Mr. Giannini I was at the site to conduct an inspection to determine the site's compliance with the Clean Water Act (CWA) and its National Pollutant Discharge Elimination System (NPDES) permit, permit # IDR10C14D. Mr. Giannini told me the site was no longer active. He said construction activities began on April 15, 2024, and ended on May 10, 2024. I asked if he'd submitted the Notice of Termination (NOT) which would have ended his coverage, and obligations, under the permit. Mr. Giannini was unaware that he was required to submit an NOT and thought he was clear of all his duties under the permit. I explained to Mr. Giannini that filing the NOT was the final step to close out his permit coverage. He said he understood and would take care of it immediately. On February 25, 2025, the day after the inspection, Mr. Giannini sent me an email with verification from IDEQ that the NOT had been filed that day. It was filed the day after the inspection on February 25, 2025. SECTION IV - Sampling Activities No sampling was conducted. AOC Reference #: RA1-RR-002 Records Review: Notice of Termination Permit Requirement Part 8.2. of the permit states, in part, "You must terminate CGP coverage only if you meet the condition in 8.2.1 and one or more of the conditions in Sections 8.2.2 through 8.2.4 have occurred...1. The permittee certifies that their project is not subject to any pending State or Federal enforcement actions, including citizens suits brought under State or Federal law, and 2. You have completed all construction activities at your site and, if applicable, construction support activities covered by this permit..." AOC: At the time of inspection on February 24, 2025, the site owner/permittee had not filed a Notice of Termination (NOT) indicating the project had been completed. SECTION VI - Closing Conference I held a telephonic closing conference with Mr. Giannini at 11:40 AM (PT) on 02/24/2025 for the inspection. During the closing conference, I reiterated the need for Mr. Giannini to submit the Notice of Termination.
