Environmental Protection Agency Region 4 Air Enforcement Branch 61 Forsyth Street, SW Atlanta, Georgia 30303 INSPECTION REPORT Facility Inspected 1666 Marietta Highway Canton, Georgia 30114 Inspection Date: March 29, 2023 Facility Programmatic ID 3601515880 LAT: 34.2237 LON: -84.5022 Inspection Type Clean Air Act (CAA) National Emission Standards for Hazardous Air Pollutants (NESHAP) - Asbestos Inspector Pamela Storm Introduction An inspection pursuant to Section 114 of the CAA was conducted on March 29, 2023, at 1666 Marietta Highway in Canton, Georgia 30114 (the facility). The unannounced inspection was conducted by Pamela Storm who possesses EPA inspector credentials to conduct CAA NESHAP asbestos inspections. The facility is a former gas station that is being remodeled to be a new BP gas station. Renovation permit #R02105-099 was issued by the City of Canton to applicant Paul R. Kelley, 1245 Rainey Road, Macon, Georgia 31220 (phone: (478) 474-8794) on September 16, 2021. This permit lists the owner as Tony M. Little, 2405 Canton Road, Marietta, Georgia 30060. This permit lists the contractor as Chandler Custom Contracting, LLC, P.O. Box 23, Talking Rock, Georgia 30175. A phone number of (404) 610-6630 with an e-mail of rnhada@gmail.com was listed on this permit (later indicated by the contractor to be contact information for the subcontractor). Also, plumbing permit #P2303-026 was issued by the City of Canton to applicant New Vision Plumbing, LLC, 198 Davis Court, Hiram, Georgia 30141 (phone: (404) 867-6976) on March 15, 2023. A contact email of NVPLLC198@yahoo.com was listed on this permit. In addition, Land Disturbance Permit #LD2203-123 was issued by the City of Canton to build an "addition to existing gas station" on January 24, 2023, to owner 1666 Canton LLC, 3125 Touchton Court, Duluth, Georgia 30097. All of these permits were posted at the site at the time of this inspection. No work was occurring at the site during this inspection. Extensive renovations had occurred. The purpose of the inspection was to determine compliance with the CAA NESHAP Asbestos Standard and the regulations promulgated at 40 CFR Part 61, Subpart M, for the renovation/demolition activities conducted pursuant to these permits. The EPA Region 4 CAA NESHAP asbestos program targets facilities for inspection located in the State of Georgia based on tips/complaints; permits issued on a local level; and demolition and/or renovation/abatement notices sent to the State. This inspection was conducted based on a tip/complaint and the previously mentioned permits. Inspection Inspection Upon arrival at the facility, no one was at the facility. The EPA inspector observed that new posts and a new overhead canopy for gas pumps had been installed on new concrete slabs. The majority of the convenience store portion of the facility had been removed. Only one-third of one interior wall remained (approximately 12 feet by 16 feet remained) and one and one-third of the exterior walls remained. Metal and wooden support beams and the roof remained. All of the previous convenience store's interior had been removed including bathrooms in their entirety (fixtures, walls, doors), walls except what has been previously mentioned as remaining, ceiling materials (pink insulation and black "garbage-bag" like plastic remain) except for 14 ceiling panels hanging down. Portions of piping had been removed from the ceiling. All of the flooring materials and portions of the cement foundation had been removed. Underground pipe was visible under in some portions of the removed foundation. Piles of small rock with some co-mingled cinderblocks were observed. A dumpster from Xtreme Disposal (phone: (404) 884-5244) was at the site along with 3 "Gomini's" mini-storage bin rentals numbered #133, #127 and #175 (phone: (256) 881-2800), While the EPA inspector was conducting this inspection, Greg Chandler, the owner of Chandler Custom Contracting, LLC, drove up to the facility. He explained that he was the general contractor, and he provided his e-mail (chandlercustomcontracting@gmail.com) and phone number [(404) 395-9290]. The EPA inspector presented her inspector credentials and explained that EPA was conducting the inspection of the permitted activities for compliance with the Asbestos NESHAP. Greg Chandler explained that activity at the facility had begun in 2021. He did not know if an asbestos inspection had been conducted in accordance with 40 C.F.R. Section 61.145(a) of the Asbestos NESHAP prior to the disturbance of building materials and facility components. He said he would check with the subcontractor about this. The EPA inspector provided a synopsis of the Asbestos NESHAP requirements as well as her contact information. Conclusion The EPA inspector will follow up with the owners/operators of the facility and the renovation/demolition activity, as deemed appropriate, to obtain information and necessary paperwork related to this activity. This information will include, but not necessarily be limited to, copies of asbestos inspection reports, notifications, and waste shipment records for the facility.
