BACKGROUND Heusinkveld Farms, LLP. April 28, 2025 On April 28, 2025, EPA conducted an NPDES Clean Water Act (CWA) compliance inspection at Heusinkveld Farms, LLP. (the Facility) in Spring Valley, Minnesota. This inspection was performed pursuant to Section 308(a) of the Federal Water Pollution Control Act, as amended. The Facility considers itself to be three sites. On the east side of County 5 to the north is the dairy site owned by Heusinkveld Farms LLP with a portion of the site siting on a parcel owned by Darla Heusinkveld. On the east side of County 5 to the south is the dry cow site is currently owned by Stephen Heusinkveld but is being purchased by the Operator. On the west side of County 5 is the heifer site owned by Nathan & Misty Heusinkveld. For the purposes of this inspection, the three sites will collectively be referred to as "the Facility". The Facility has approximately 460 dairy cows (dry or milking) and 200 heifers. The Facility is a medium animal feeding operation based on it having stabled or confined more than 200 mature dairy cows for 45 days or more in any 12-month period. Surface runoff from the Facility generally flows into the adjacent crop fields. The Facility's topography is hilly with steep slopes (see Attachment A). The Facility is bracketed to the north and south by National Hydrography Dataset identified unnamed intermittent tributaries of the South Branch Root River which have a confluence approximately 2,000 feet east of the Facility. These unnamed intermittent tributaries are mapped as flowing approximately 3.8 miles from their confluence east of the Facility to the perennial South Branch Root River. South Branch Root River is listed on the 303d impaired waterway list as being impaired for Murky Water. South Branch Root River flows to the Root River which flows to the Mississippi River, a Traditional Navigable Waterway. 2. The Dry Cow Barns, Cattle Shed, Top Barn and Bottom Barn are scraped and hauled as needed. The outdoor lot of the Top Barn is scraped to the 15,000-gallon pit on the west side of the Top Barn. Describe the way used bedding is collected and disposed of at the facility: Sand is used as bedding in the Dairy Barn. Straw and corn stocks are used as bedding for calves, heifers, and dry cows. Yes Date NMP Submitted: 2023 Planner Name/Company: Fillmore County Soil and Water Conservation District Date that the NMP was last 2023 updated: Table 9: NPDES Permit Type of permit (General, individual) No NPDES Permit 2.2 Walkthrough of the Facility Prior to the inspection, Ben Atkinson contacted Mr. Nathan Heusinkveld (the Operator) and notified him that the United Stated Environmental Protection Agency (US EPA) intended to conduct a Clean Water Act compliance inspection at the Heusinkveld Farms facility on April 28th, 2025 and asked if facility personnel would be available to assist during the inspection. The Operator stated that he would be available. Mr. Atkinson informed the Operator of EPA's biosecurity procedures and asked if any additional biosecurity procedures were needed at the facility. The Operator stated that EPA's standard procedures were sufficient. On the date of the inspection, EPA inspectors Ben Atkinson and Cheryl Burdett (the Inspectors) along with Minnesota Pollution Control Agency Environmental Specialists Peter Kuisle and Brent Riess (MPCA), and Fillmore County Feedlot Officer Dallas Dornink (the County) arrived at the Facility at 9:39 AM. The Inspectors stopped and disinfected their vehicle's tires prior to driving onto the Facility. The Inspectors then parked, donned their disposable biosecurity boots, and approached the Operator. The Inspectors presented their credentials, confirmed that the location where they parked was acceptable, and asked if there was a space where the opening conference and interview portion of the inspection could be held. The Operator stated that their vehicle was parked in an acceptable location and led the Inspectors to the Office. The Inspectors explained that the inspection would be comprised of an interview portion to gather information about the Facility and a walkthrough of Facility. The Inspectors explained the Facility's right to claim information as Confidential Business Information (CBI) and asked if there was anything that would be considered CBI. The Operator stated he did not think anything would be CBI. The Inspectors explained that were a discharge to be observed, that samples may be collected and that split samples could be collected and preserved by EPA for the Facility to have analyzed if the Facility requested. The Inspectors then conducted the interview portion of the inspection. The Inspectors asked the Operator to clarify if the three adjoining sites were considered one operation. The Operator stated that he thought they were technically three operations with different legal ownership of the dairy site (owned by Heusinkveld Farms, LLP., dry cow site 7 Heusinkveld Farms, LLP. April 28, 2025 (owned by Stephen Heusinkveld but in the process of being purchased), and heifer site (owned by Nathan & Misty Heusinkveld). The Inspectors explained that under the Clean Water Act, two or more animal feeding operations that are under common ownership are considered to be a single animal feeding operation for the purposes of determining the number of animals at and operation if they adjoin each other or if they use a common area or system for the disposal of wastes. The Inspectors stated they would like to conduct the inspection assuming the three sites were one operation and address the question of whether the sites were a single operation following the inspection if needed. The Operator agreed to allowing access to inspect all three portions of the Facility. At approximately 10:30 AM, the interview portion of the inspection was completed, and the walk-through of the Facility began. The Inspectors began the walk-through at the Office and walked northeast to the southeast corner of the Machine Shed. The Inspectors then walked north between the Machine Shed Calf Barn 1 to the outdoor lot north of the Machine Shed. The Inspectors observed that the outdoor lot was partially denuded (photos 1-4). The Inspectors then walked back around the south end Calf Barn 1 and observed calf hutches between Calf Barn 1 and Calf Barn 2 (photo 5). The Inspectors walked north between Calf Barn 1 and Calf Barn 2 and observed the outdoor lot at the north end of Calf Barn 2. The Inspectors observed that the lot was denuded (photo 6). The Inspectors then walked east and observed a white pipe protruding from the hillslope northeast of Calf Barn 2 (photos 7 and 8). The Operator identified the pipe as coming from calf milk room in Calf Barn 2. The Inspectors walked east along the north side of the Feed Bunker and observed a flow path with white colored liquid originating from the pipe form Calf Barn 2 (photo 9). The Inspectors observed that there was no liquid in the flow path approximately 130 feet from the source (photo 10). The Inspectors walked east to the northeast corner of the Feed Bunker and observed holes and erosional flow paths in the soil at the base of the northeast corner of the Feed Bunker with a dark color liquid and staining present (photos 11-13). The Inspectors walked south and observed an access road between the Feed Bunker and the Big Pit (photo 15). The Inspectors walked southeast to the northeast corner of the Big Pit (photos 16 and 17). The Inspectors observed an erosional flow path from the access road east of the Big Pit into the crop field east of the Big Pit (photos 18 and 19). The Inspectors walked around the east side of the Big Pit and then west along the south side of the Big Pit (photo 20). The Inspectors observed an erosional flow path along the fence to the south (photo 21). The Inspectors walked west and observed manure solids on the top of the wall of the Big Pit and on the ground on the south side of the Big Pit (photo 22). The Inspectors observed an erosional flow path to the south (photo 23). The Inspectors continued west and observed manure solids on the top of the wall of the Sand Pit and on the ground south of the south wall of the Sand Pit (photo 24). The Inspectors 8 Heusinkveld Farms, LLP. April 28, 2025 observed an erosional flow path along the south side of the Dairy Barn parallel to the Dairy barn which then turned south (photos 25 and 26). The Inspectors walked west and observed a blue pipe protruding southeast out of the hillslope south of the Dairy Barn with an erosional flow path southeast (photos 27 - 29). The Operator stated that the pipe conveyed stormwater from the area north of the Parlor Water Pit. The Inspectors walked around the south side of the Parlor Water Pit and observed a white pipe on the west side of the Parlor Water Pit (photo 31). The Operator stated that this was an older now unused pipe that had conveyed stormwater from the area north of the Parlor Water Pit. The Inspectors walked southwest and observed the outdoor lots north of the Dry Cow Barns. The Inspectors observed that the outdoor lots were partially denuded with erosional flow paths south to the crop field south of the outdoor lots (photos 32-36). The Inspectors also observed an erosional flow path along the south fence of the outdoor lots (photo 37). The Inspectors walked south to the north side of the Dry Cow Barns (photos 38 and 39). The Inspectors walked southeast and observed the east side of the Dry Cow Barns and observed manure off the edge of the concrete pad south of the Dry Cow Barns (photos 41 and 42). The Inspectors then walked southwest and observed erosional flow paths from the denuded lot north of the Cattle Shed through the denuded lot south of the Dry Cow Barns to the crop field south of the outdoor lots (photos 43-46). The Inspectors also observed an erosional flow path from the area south of the Dry Cow Barns along the fence to the east (photos 47 and 48). The Inspectors then walked east along the north side of the denuded outdoor lot north of the Cattle Shed (photos 49-52). The Inspectors then walked south along the east side of the denuded outdoor lot north of the Cattle Shed (photo 53). The Inspectors then walked north and observed the south side of the outdoor lot north of the Cattle Shed (photos 5455). The Inspectors then walked northwest around the southwest side of the Cattle Shed and Dry Cow Barns (photos 56 and 57). Then Inspectors then walked north along the west side of the outdoor lots north of the Dry Cow Barns and crossed County 5 to the heifer site. The inspectors walked to the southeast side of the Bottom Barn and observed the partially denuded outdoor lot north of the Bottom Barn (photos 58 and 59). The Inspectors then walked back to the southeast corner of the Bottom Barn to the concrete outdoor lot on the south side of the Bottom Barn (photo 60). The Inspectors walked west and observed the manure stacking area to which the Bottom Barn manure is scraped (photo 61). The Inspectors walked north and observed an erosional flow path beginning at the fence to the outdoor lot north of the Bottom Barn (photo 62). The Inspectors observed that there were gaps between the west wall of the manure stacking area and concrete block wall at the north end of the manure stacking area (photo 63). 9 Heusinkveld Farms, LLP. April 28, 2025 The Inspectors then walked west around the south side of the hay barn to the southeast corner of the Top Barn. The Inspectors observed a recessed manure stacking area on the east end of the Top Barn (photo 64) and the outdoor lots on the south side of the Top Barn (photo 65). The Inspectors then walked North on the east side of the Top Barn and around the silage mound north of the Top Barn. The Inspectors observed erosional flow paths from around the silage mound to the crop fields adjacent to the silage mound (photos 66-68). The Inspectors then walked to the west side of the Top Barn and observed a flow path with dark colored liquid and staining from the 15,000-gallon pit on the west side of the Top Barn to the adjacent crop field (photos 69-71). The Inspectors observed the outdoor lots on the south side the Top Barn (photo 72). The Inspectors then walked east to the east side of County 5 and north to the southwest corner of the North Silage Pad (photo 73). The Inspectors walked north along the west side of the North Silage Pad and observed erosional flow paths along the west side of the North Silage Pad to the crop field to the north (photos 75 and 75). The Inspectors then walked north to the north end of the silage mound north of the North Silage Pad (photos 76-78). Then Inspectors then walked south to the north side of the North Silage Pad. The Inspectors observed staining at the seams of the north wall of the North Silage Pad (photos 79-80). The Inspectors then walked south on the east side of the North Silage Pad and observed erosional flow path with dark staining from east side of the North Silage Pad to the crop field to the east (photos 81-84). The manure solids on the south side of the Big Pit and Sand Pit may be contributing pollutants to runoff flowing through erosional flow paths toward the intermittent waterway to the east. 7. The outdoor lots north of the Dry Cow Barns are denuded and have erosional flow paths that may convey pollutants toward the intermittent waterway to the east. 8. The concrete pad on the north side of the Dry Cow Barns lacks containment. 9. The outdoor lots south of the Dry Cow Barns and north of the Cattle Shed are denuded and have erosional flow paths that may convey pollutants toward the intermittent waterway to the east. 10. The outdoor lot north of the Bottom Barn is partially denuded and has erosional flow paths that may convey pollutants to the intermittent waterway to the north. 11. The manure stacking area on the west side of the Bottom Barn has gaps which may allow pollutants to flow to the erosional flow paths in the outdoor lot north of the Bottom Barn. 12. The silage mound north of the Top Barn lacks runoff containment and may contribute pollutants to the erosional runoff pathways toward the intermittent waterway to the north. 13. The 15,000-gallon manure pit on the west side of the Top Barn appears to be overflowing and may contribute pollutants to runoff in the erosional flow paths toward the intermittent waterway to the north. 14. The North Silage Pad lacks runoff containment and may be contributing pollutants to the erosional flow paths toward the intermittent waterway to north and east. 15. The silage mound north of the North Silage Pad lacks containment for leachate or runoff. 5.
