Hi Kathryn, our response below is attributable to an EPA spokesperson:
EPA regulates non-transportation-related oil storage tanks under the agency's oil spill prevention program which includes the Spill Prevention, Control, and Countermeasure (SPCC) and the Facility Response Plan (FRP) rules. The SPCC rule requires facilities to develop and implement SPCC Plans that establish procedures, methods, and equipment to prevent a discharge of oil into navigable waters of adjoining shorelines. The FRP rule requires certain facilities to submit a response plan and prepare to respond to a worst case oil discharge or threat of a discharge. These rules do not specify requirements for seismic standards; however, the SPCC rule requires that a professional engineer certify that the SPCC Plan is prepared in accordance with good engineering practices, including consideration of applicable industry standards. Oil storage tanks may be subject to other Federal agencies jurisdictions (e.g., US Department of Transportation Pipeline and Hazardous Materials Safety Administration).
