My apologies for taking so long to respond on the FRN question below. An analyst from my staff can assist you in preparing a Fed Reg Notice. It will need to be signed by the NFS line officer, and we'll want to coordinate through Glenn to be sure the several regulatory review efforts are in sync. Lets discuss when you're back so we can help move that forward.
I'm also attaching some comments we received through NRE; you may have already received but I just wanted to be sure.

Hello there , and another question. The executive lead on this EO (Nick Douglas) wishes to publish under an 'opportunity to comment' on the Forest Service draft report in the FR to address OMBs guidance requiring the agencies to seek input from entities affected by agency action that burden energy development (a side note, OMB is directing the final Report be published in the FR). Do you know what internal channels we have to follow to prepare a FR notice and have it published? Thanks, LM

Hi Liane, I'll need to get back to you. It is my understanding that any changes to the CFR require publication in the Federal Register; not everything requires agencies to take public comment, however. I need to clarify whether there are other procedural options (i. e. suspend and rescission) and the related requirements.

Thanks Melinda, seeing the whole thing written out makes sense.
On another note, I was thinking about a comment Annie made Friday. EO 13783 calls for the agency to identify 'agency actions' (which are regs, policy, guidance, etc.) which would be recommended to revise, rescind or suspend if found to place unnecessary burden on energy resource development. I think Annie asked 'can FS rescind'? It seems like there may be an issue with semantics in the EO. Would you please help me understand what 'words' the FS or USDA uses with respect to changing regulations, the FSM or FSH. Thanks, LM
