Inspector met with Mr. Doug Lantz (Manager) at the Opening Conference. Inspector presented their credentials to Mr. Lantz and informed him that this was an EPA inspection to determine the facility's compliance status with the Concentrated Animal Feeding Operation (CAFO) regulations as authorized by Clean Water Act (CWA) Section 308. The scope of the inspection included a compliance evaluation of the facility's site operations and record keeping requirements of the permit. Inspector wore boot covers. The inspection was performed in a company vehicle. Inspector was accompanied by Mr. Lantz. FACILITY DESCRIPTION Dumas Feedyard reported that they currently had 26,900 beef cattle in confinement. They are permitted for 35,000. The average time cattle are kept on site is 180 days. Animals are housed in open lot pens. Pens are cleaned via scraping. The manager states the whole yard is cleaned every 45-60 days. Palo Duro Creek runs through the facility on the northern side (Appendix 1, Photos 3, 4, 11, 12, 14 & 15). The facility has five retention control structures (RCS): RCS 1A, RCS 1B, RCS 2, RCS 2A, and RCS 3 (Appendix 1, Photos 1, 2, 7, 9, 10, 13, 16 & 20). Wastewater is routed from pens to RCSs via gravity flow using grading and drainage channels (Appendix 1, Photos 2, 6, 7,8 19, 20 & 21). All manure solids are transferred offsite to 3rd party farmers. The facility also has two land management units (LMUs): LMU 1 (135 acres) and LMU 2 (120 acres). The facility double-crops wheat and sorghum silage. Center pivots are used for wastewater application on LMUs. Commodities are stored on site in bales, silos, and covered bunkers (Appendix 1, Photos 1, 5 & 22). Mortalities are hauled and disposed of offsite by a 3rd party company. The facility utilizes the services of Texas Cattle Feeders Association and Enviro Ag Engineering. Section II - OBSERVATIONS Dumas Feedyard has the requirements to meet the large CAFO regulatory definition. The facility has berms on either side of the Palo Duro Creek to prevent wastewater runoff from entering the waterway (Appendix 1, Photos 3, 4, 11, 12, 14 & 15). The berms are in good condition and seemed adequate to prevent a discharge at the time of the inspection. The holding pens are clean with no visible manure piles and graded properly to direct runoff to drainage channels that flowed to RCSs throughout the site. Manure stockpiles on site were within the drainage area of an RCS (Appendix 1, Photos 2, 4, 9 & 16). There was a single mortality that was set aside for pickup at the time of the inspection (Appendix 1, Photo 18). All records required by the permit were present on site at the time of the inspection. The NMP was prepared by TCFA and most recently updated on 02/13/25. A calculation of the agronomic rate was done using the facilities land application data sheets (LADS) and determined that the facility was properly applying wastewater to their LMU 1 for the 2024-2025 crop year. A check of the lagoon designs and as-builts showed adequate storage for the production area and 25-year/24-hour rain event. The lagoons are all clay lined and certified. Infiltration tests were all shown to be above the minimum requirement of hydraulic conductivities no greater than 110-7 centimeters per second. The most recent 5-year evaluation of the RCSs was conducted on 09/21/20 by Benjamin Weinheimer of TCFA. A visual check of the lagoons was conducted and there was adequate freeboard, pole markers, lack of erosion, no solids overloading, and no evidence of unauthorized discharge. However, there were no lagoon fences present (Appendix 1, Photos 1, 2, 7, 9, 10, 13, 16 & 20) (see Areas of Concern 2). There was also some vegetation growing in the RCS 1A (Appendix 1, Photos 9 & 10) (see Areas of Concern 2). No other potential issues were found during the inspection. 2 Dumas Feedyard Inspection Date 03/03/2025 Section III - AREAS OF CONCERN 1) There is vegetation growth inside RCS 2. Part III.A.10. (f)(3) of the TPDES CAFO General Permit requires "No tree shall be allowed to grow such that the root zone would intrude or compromise the structure of the liner or embankment." 2) There is a lack of fencing for RCSs. Part III.A.10. (f)(2) of the TPDES CAFO General Permit requires "Liners must be protected from animals by fences or other protective devices." There were no other areas of concern at the time of the inspection. EPA Region 6 inspector conducted a closing conference for the Dumas Feedyard inspection at approximately 10:57AM on March 3, 2024. During the closing conference, the inspector reviewed findings with the Mr. Lantz. Section IV - FOLLOW UP No follow up with the facility has occurred since the time of the inspection.
