UNION CARBIDE CORPORATION LAW DEPARTMENT 39 OLD RIDQEBUKY ROAD DANBURY, CT 06817 August 28,1995 TO: B.D. Fitzgerald J. Michaud K.M. Myers RE: Grace Overstreet, et aL v. Dow Chemical Company and Union Carbide Corporation The plaintiffs have moved to dismiss the only present defendants, Union Carbide and Dow, in the above case with prejudice (i.e., they cannot refile). This case involved death of a contractor's employee for brain cancer allegedly from exposure to vinyl chloride. The dismissal appears to result from non-existence of records as to where the decedent worked. The plaintiffs sought dismissal without prejudice, but we argued, and the judge ordered, that the dismissal be with prejudice. RAB/rkr cc: -- G.DI . Winfree Robert A.
