O'Reilly - Los Angeles Carson Copies: File Date: February 21, 1975 Subject: R IV E R S ID E CEMENT COMPANY OCCUPATIONAL HEALTH APPEALS BOARD HEARING FEBRUARY 10, 1975 George Borg reports he has talked with Jim Reis so I believe you already have this information. The hearing involved one of Riverside's customers (an application contractor) who had applied a gun plastic material containing asbestos as an outer coating on residences. The Inspector noted a build-up of this material at the point where the foundation meets the ground, and found the contractor chipping off this material and sweeping it up. Therefore he cited the contractor for improper disposition of asbestoscontaining materials. Riverside wished to maintain a low profile at this hearing but they did send their consultant to act on the contractor's behalf. Their premise is that since the asbestos is locked in, the Regulation does not apply. Although the ruling has not been published yet, they are highly confident that their interpretation has prevailed. Now, George would like the latest information on the proposed amendment to California Senate Bill number 2419, to remove the restriction which allows 1/2 of If asbestos effective July 1, 1975, and on July 1, 1976 prohibits the use of asbestos entirely. He reports they are living with the 1/2 of 1%, but a reduction to zero will kill the business. CL M A a * 4a>o-cJLJl CRMC-RiversideCement-000052
