The above party was employed by M s father, in the capacity of warehouseman at the bulk distri buting station ope .o',tod. by 1. sf. DuBois at Cookeville, Tenu. At the time of the accident in question he approximately 26 years of age. It is claimed that was partially over come while unloading a tank car of gasoline early in the summer of 1932 and that a serious-throat and mouth infection subsequently set in, resulting in his death. (The complaint filed in connection with the litigation further alleges that his nose, chest, kidneys, liver and other parts of the body were seriously infected). As to the cause of the infections, the complaint alleges that he "came in contact with rnnch of the fumes and vaport froia said gasoline which contained a mixture of lead and other poisonous substances". The particular acts of negligence charged are that end others working around the premises were not informed of the dangerous and deadly character of the fumes end vtpors of the gasoline and' were not furnished with masks. |d_ oonoil At the outset the father of the de ceased coatended that the doctor and local undertaker both attributed the b e y 's death to lead poisoning and he was in formed by a representatire of'another oil company that 21 employes of that company had died from similar causes with in ?, the past year, fhe doctor who attended the young man during his last illness dis ~ the'death as due to acute lymphatic leukemia but did not/^the cause of the leukemia.
