General Facility and Process Description: (b) (6), (b) (7)(C) greeted the inspectors and stated that this location was not a business, and he was not the owner. His wife owns the building. He stated that it is a residence, not an operating business. At this shop, he only does private work on his vehicle or the vehicles of friends and family. Ft. Peck Auto continues to tow cars but they haven't done any auto repair here in the past year. He stated that about 15 used oil drums had been removed since the last time representatives of the tribal environmental program came by. For example, a farmer, (b) (6), (b) (7)(C) , has taken some of the used oil to burn for heat in his shop. (b) (6), (b) (7)(C) said that there were 18 drums of used oil remaining, some with just residue and some close to being full. When (b) (6), (b) (7)(C) took 10 drums, two were accidentally punctured by a forklift and there is spilled oil on the soil. This area is a brown field area. When his wife purchased this shop in 2018, the drums of used oil were already here. The prior owner was (b) (6), (b) (7)(C) who operated the shop under the name Mato Automotive. He again stated that they never did oil changes as a business. He stated that he will take responsibility for the drums, clean up what was on the surface, and intends to continue to dispose of the drums. CBI: No CBI was discussed during the inspection. Areas of the facility toured: We were not permitted access into the shop areas. We entered the building and spoke with (b) (6), (b) (7)(C), who allowed us to access the side yard and take photographs of the used oil drums. We saw 28 drums total, of which three drums were empty. We also saw the soil spill area, oily dirt by the manhole cover, and the two punctured blue drums. Some of the drums were reused pesticide drums. For example, one drum with a pesticide label holding used oil was also labeled as "Nonselective Foliar Systemic Herbicide". Records Review: No records were reviewed prior to or during the inspection. Inspection Follow-up: Based on an internet search on October 17, 2023, Ft. Peck Auto is open Monday through Friday from 9 a.m. to 6 p.m. each day. The site states that it is a "Native American Woman Owned Business". The agent is listed as (b) (6), (b) (7)(C).
