Chapter 21E On behalf of our Vice President and General Manager, Mr. Richard C. Maloof, I am responding to your letter dated December 4, 1986, which we received on Tuesday afternoon, December 9, 1986, and, specifically, in response to the "REQUISITE SITE ACTIONS" section of said letter, be advised of the following: 1. Marlyn Engineering Corporation, 20 Pond Street, P.0. Box 209, Whitman, Massachusetts 02382, which has been retained by Bird to remove the asbestos-containing material, has secured the area where the asbestos-containing material has been found, including the placement of "asbestos caution tape" and descriptive signs. 2. All asbestos-containing material has been covered except the pipes on the roof and four overhead tanks which are partly in and partly out of the building. We will consult with Marlyn and others about having the pipes and tanks covered, or we will direct Marlyn to immediately commence removing the asbestos. In that regard we intend to direct Marlyn to forthwith complete the entire cleanup of the area as described and scoped out in Marlyn's letter to Bird dated September 23, 1986, a copy of which is attached. 3. A leak-tight container has been installed on site, as you required in Section 3. 4. The priority cleanup for friable asbestos is acknowledged. Marlyn estimates that the priority asbestos cleanup will be completed within several weeks. Mr. Richard J. We believe that the "glove bag method of removal" is customary usage by Marlyn. 6. We agree to the personal protection requirement set forth in Section 6, and Marlyn is implementing same. 7. The report required by Section 7 is as follows: In September, 1985, as part of a 5-year plan to demolish the tank farm and 4 or 5 other old buildings. Bird committed a sum of money for that purpose. During the bidding process, the demolition companies pointed out the presence of asbestos-containing materials. Subsequently, Bird requested bids for asbestos removal and demolition and awarded the job on October 15, 1985, to Scrap-All Incorporated, 383 Evergreen Street, Pawtucket, Rhode Island 02861. Work commenced on November 1, 1985. In March, 1986, Scrap-All, having completed 90% of the demolition work, left the job site. In April, 1986, the DEQE visited the site and made no comment regarding the areas containing the asbestos material. Therefore, we had no reason to suspect that any release or threat of release was present at that time, since it was not brought to our attention. On June 6, 1986, Bird demanded by a certified letter that Scrap-All complete the job. Bird's letter could not be delivered by the Post Office and was returned to the sender. On July 25, 1986, Bird received notice from Scrap-All that it would be impossible for them to complete the job because Scrap-All could no longer obtain insurance to protect its workers. No response other than that could be solicited. In August, 1986, Bird solicited bids from other hazardous waste removal and demolition contractors. 0040co Mr. Richard J. (continued) During the bid process, Marlyn inspected the site and offered Bird a proposal for asbestos removal. On October 15, 1986, after a review of the bids, Marlyn was awarded the bid and commenced working. In regard to the origin of the asbestos, these portions of the roofing plant were constructed between 1902 and 1935. Apparently asbestos was used in the original construction, it being the industry standard during that period of time. We are writing to Marlyn to review your letter of December 4, 1986, and we would like to arrange a meeting next week with Mr. John MacAuley of your staff as well as representatives from Marlyn and Bird. Our Manufacturing Manager, Mr. John Hardy, will be calling Mr. MacAuley on December 17 to arrange a convenient time.
