Enclosed is a summary of the circumstances and of actions taken. A. This notice has been sent by Certified Mail. B. This notice is being submitted in accordance with EPA's March 16, 1978, Statement of Interpretation for Notification of Substantial Risk: Section 8(e) of the Toxic Substance Control Act as published in 45 Federal Register 11110. C. D. Our formulation consists of: Heavy naphthenic distillate (CAS #64742-52-5), Heavy naphthenic distillate (CAS #64741-53-3), Sodium alkylbenzenesulfonic acid (CAS #78330-12-8), Ethoxylated tallow alkyl amine (CAS #61791-26-2), Di-tert-butyl nonylphenol (CAS #4306-88-1) and Oleylsarcosine (CAS #110-25-8). E. On May 5, our customer inadvertently spilled 100 gallons of our formulation from a hose connection that released the formulation to the floor. It is estimated the 60 gallons entered a floor drain to a catch basin, and ultimately Elliott Ditch. It is estimated that 1000 fish in the waterway were killed. On May 7, our customer became aware of the release and our 24-hour emergency response center was notified. The incident is under review by the Indiana Department of Environmental Management and The National Response Center (NRC) was also notified. Only our identity is being claimed as confidential business information so that the linkage to our formulation is not readily discernible to our competitors.
