The fuel at this Facility is sold to the public. The Environmental Protection Agency's Facility records indicate that the Facility has two cathodically protected steel single-walled underground storage tanks (USTs), which were installed in 1998. Tank 1 has a capacity of 8,000 gallons and is used to store regular unleaded gasoline. Tank 2 has a capacity of 8,000 gallons and is used to store diesel fuel. Facility piping is pressurized and constructed with double-walled fiberglass reinforced plastic materials. Inspection Narrative On July 23, 2025, the EPA conducted an inspection at Yellowtail Market in Fort Smith, Montana. The EPA last inspected the Facility on October 12, 2022, and selected it for routine re-inspection. On June 26, 2025, the EPA contacted the Facility operator to schedule the inspection. See Attachment A for the record of communication with the Facility representative. The EPA inspector arrived at the Facility at approximately 11:50 a.m. The EPA inspector introduced herself and presented inspector credentials. The Facility representative consented to the inspection. 2020064 - Yellowtail Market Page 1 of 3 07/23/2025 UST Inspection The EPA inspector conducted a physical inspection of the UST system as well as a review of Facility records. Copies of operation and maintenance records are in Attachment B. Photographs of UST system components taken during the inspection are in Attachment C. Tank Leak Detection Tank leak detection consists of a Veeder Root TLS-350 automatic tank gauge (ATG) system which conducts continuous statistical leak detection. The Facility representative provided 12 months of passing release detection monitoring for both USTs. The annual ATG operation inspection was performed on October 3, 2024, and all equipment passed. Piping Leak Detection Lines are all equipped with electronic line leak detectors (ELLDs). The ELLDs were tested on October 3, 2024, and the diesel LLD failed due to an issue with the connection at the shear valve. The shear valve was repaired and the LLD re-tested on January 10, 2025. The Facility representative provided 12 months of passing release detection monitoring for both lines. Cathodic Protection The USTs are single-walled STI-P3 construction. Facility records indicate the last two passing surveys were performed on July 28, 2021, and October 3, 2024. Periodic Testing/Inspection of Spill and Overfill Prevention Equipment The overfill prevention devices were inspected/tested on October 3, 2024. The diesel tank's overfill valve failed and was replaced by a service provider on January 10, 2025. The spill buckets were tested and passed on October 3, 2024. Periodic O&M Walkthrough Inspections Records of the monthly and annual walkthrough inspections for the last twelve months were available at the time of the inspection. Operator Training Certificates for the Class A and B operator were present during the inspection. Wilson is designated as the Class A operator and Wilson is the Class B operator. The Facility representative also maintained training records of the Class C operators. Financial Responsibility On-site records indicate that the Facility is enrolled in the Montana Petro Fund to meet the financial responsibility coverage requirements. The Facility has the required documentation for the state fund available onsite. Physical Observations The EPA inspectors viewed the tank top sumps, spill buckets, fill ports and dispensers. The sumps and the unleaded spill buckets were clean, intact and functional. Flapper valves were present in each of the drop tubes. During the physical inspection, the EPA inspector noted that the metal portion of the 2020064 - Yellowtail Market Page 2 of 3 07/23/2025 UST Inspection unleaded piping in the tank top sump was in contact with the surrounding soil. This will cause corrosion if not kept separated. The EPA inspector recommended the operator have the soil removed from around the piping. Conclusion At the end of the inspection, Ms. Person filled out an Onsite Deficiency Identification Form (see Attachment D), which represents the EPA staff's initial compliance recommendations at the time of the inspection. Ms. Person provided the onsite deficiency form to the operator and retained the carbon copy for recordkeeping. Prior to departing the Facility, Ms. Person stated that a full inspection report would be forthcoming, which includes the inspection checklist (see Attachment E). On August 17, 2025, the EPA received documentation of the annual and triennial testing, as well as the repair and re-testing of the LLD. Inspection Report Attachments A.
