Mr. Hf.lstoski, Mr. Kocn, Mrs. Mink, Mr. Mitchell, Mr. Rangel, Mr. Roe, Mr. Roap.nTfTAL, Mr. Sarbanes, Mr. Schecer, Mr. Steele, and Mr. Yatron) intro duced the following bill; which was referred to the Committee on Inter state and Foreign Commerce A BILL To prohibit the introduction or delivery for introduction into commerce of the chemical compound known as polychlo rinated biphenyl. 1 Be it enacted by the Senate and House of Represcnta2 fives of the United Stales of America in Congress assembled, 3 That for the purposes of this Act-- 4 (1) The term "commerce" means commerce between 5 any State and to or through any place outside thereof; or 6 within any territory or possession of the United States or the 7 District of Columbia; or from a foreign country to any State. 8 (2) The term "State" means each of the several States, 9 the District of Columbia, the Commonwealth of Puerto Rico, I HONS Obit3? 2 1 the Virgin Islands, American Samoa, Guam, the Canal Zone, 2 and the Trust Territory of the Pacific Islands. 3 (3) The term "person" means any private person or 4 entity, any officer, department, agency, or instrumentality of 5 any State or local unit of government, and any officer, depart6 inent, agency, or instrumentality of the Federal Government. 7 'Six. 2. It shall he unlawful for any person to introduce 8 or deliver for introduction into commerce any of the chemical 9 compound known ns polychlorinated biphenyl. 10 Site. 3. (a) Any person who knowingly violates section 11 2 of this Act shall he fined not more than S3,000 or he 12 imprisoned not more than one hundred and eighty days, or 13 both. 14 (b) Whenever any corporation knowingly violates sec13 lion 2 of this Act, such corporation, and any individual direc16 tor, officer, or agent of such corporation who knowingly or 17 willfully authorized, ordered, or performed any of the acts 18 or practices constituting such violation shall he fined not 19 more than $3,000 or imprisoned not more than one hundred 20 and eighty days, or both. 21 Sec. 4. The provisions of this Act shall first take effect 22 thirty days after the date of its enactment. HONS 061138
