Schlieper PLAINTIFF'S EXHIBIT ASARCO ELP 0004-41 6 ASAkCO El Paso Plant SAFETY & HEALTH ADDENDUM TO CONTRACT - EL PASO PLANT FEBRUARY 28, 1986 PURPOSE: The purpose of this addendum is to provide a uniform set of safety and health rules for all contractors to follow. This addendum does not supersede or change any portion of the contract. As a general rule, all safety and health requirements applicable to El Paso Plant employees shall be applicable to contractor employees. ASARCO REQUIREMENTS: Any contractor violation of ASARCO and/or OSHA regulations will result, in disciplinary action. ASARCO reserves the right to dismiss any employee or terminate construction for failure to comply. OSHA REQUIREMENTS: As required by ASARCO contracts, contractors shall enforce all applicable regulations of the Occupation Safety and Health Administration (OSHA). Many OSHA requirements particularly in the health area are special to the El Paso Plant due to the smelting of non-ferrous ores such as lead and copper. The plant is operating under strict guidelines of OSHA as well as general OSHA standards. The health of all employees and continued plant operations are dependent on following these rules: GENERAL INFORMATION: 1. Contractors will be required to provide for their own arrangements for the handling of job-related injuries and illnesses. 2. First-aid equipment and treatment will be provided by the contractor. 3. In the event of a medical emergency, ASARCO first-aid facilities and personnel are available 4. If it is determined that an ambulance may be needed for assisting in emergencies, you must notify plant security who will then make arrange ments for the ambulance and notify other personnel. 5. The engineering and/or safety office will be notified immediately of all serious equipment damage incidents and injury/illness claims by contractor employees. Copies of investigation reports and Employer First Report of Injury Forms will be provided to the Engineering Dept. Evaluation of these reports may result in further investigation by ASARCO plant safety officials as needed. 7. Possession and use of food, beverages, and tobacco products are pro hibited in the plant except for authorized lunchrooms and changerooms. 8. ASARCO will furnish a lunchroom and a changeroom with showers. 9. Respirator-wearing (regulated) areas are indicated throughout the plant by posted signs and flourescent orange painted markers. Full-time wearing of respirators is required within the regulated areas. 10. All contractors and employees shall be instructed and required to wash their hands and face before eating and smoking. 11. All contractor employees shall be required to wear protective clothing (work clothing or coveralls) as required by OSHA regulations when work ing in regulated areas. Laundering of such shall also be provided as required by OSHA. 12. Respirators and fit testing will be provided by ASARCO as required by OSHA and plant policies. Check with plant safety/health officials for recommended respirators. 13. ASARCO will furnish clean respirators and clean work clothing or coverall daily. Contractors shall receive these items daily from ASARCO's' pickup point, and shall return them to this point for cleaning. The Contractor shall enforce the proper use of these items and shall be responsible for losses and damage due to negligence. 14. ASARCO will provide training on arsenic and lead hazards as required by OSHA for contractor's employees working in regulated areas. 15. At the beginning of each project, and at ASARCO's option, each con tractor employee shall be required to have a blood lead test and at required intervals thereafter as required by OSHA and the El Paso Plant. If an employee exceeds the current OSHA allowable blood lead limit, the Plant shall require the contractor to remove the employee upon notifica tion by plant safety/health officials. The company shall furnish the contractor with the results of all blood tests. (Further instructions are necessary for women employees.) 16. A copy of the El Paso Plant Safety Rule Book will be provided to each contractor. It will be the responsibility of the contractor to make their employees aware of and to enforce such rules. 2- - ASARCO ELP 0004418 Safety & Health Addendum To Contract - El Paso Plant, Continues: SAFETY & HEALTH EQUIPMENT: 1. Hard hats of an approved type shall be worn by all employees. Aluminum and bump style caps are prohibited. 2. Safety glasses shall be worn by all employees. Sideshields are strongly recommended due to the nature of the plant. 3. Long sleeves shall be worn by all contractors due to the nature of plant operations. Cotton fabrics are recommended in hot metal areas and spark-producing environments. 4. Respirators shall be worn by all contractors at all times within regulated areas of the plant. 5. Welding hoods should be of a style to accommodate respirator-wearing while welding. 6. Contractor will furnish all safety equipment required to meet OSHA and plant requirements. SAFETY RULES: The following rules are considered special or unique to plant operations. Although a complete list of safety rules cannot be provided, it is expected that all contractor employees will use common sense and work safely at all times. Refer to the plant Safety Rule Book for further information. Remember, failure to adhere to OSHA and ASARCO safety and health rules may result in employee discharge or termination of construction work. 1. Employee working at a height of 10 feet or higher will be required to wear safety belts/lanyards unless protected by handrailing. 2. Employees will not ride crane hooks (headache balls) or climb up/ descend steel columns. Ladders shall be used. 3. Hazardous overhead work and other work areas shall be appropriately posted and/or barricaded as required by OSHA. 4. Compressed oxygen/acetylene cylinders will be kept upright secured and valve caps in place at all times. 5. Welding torch leads, hoses, etc. will not be left in walkways or near stairs. Hoses, lines, etc. will be so arranged as to prevent trip ping and housekeeping hazards. 6. A safety lockout system shall be used by contractor employees to prevent accidental energization of equipment.
