Brian Kelly's Kelly Automotive Group currently has nine brands and seven locations in Massachusetts. Kelly Honda sells and services Honda vehicles. Number of Employees and Working Hours: There are over 25 employees at Kelly Honda, and working hours are: Monday - Friday from 8:00 am - 8:00 pm and Saturday from 8:00 am 6:00 pm. Potentially Applicable Clean Air Act Requirements: Recycling and Emission Reduction, 40 CFR Part 82, Subpart B (This is a federal standard that establishes requirements for the Servicing of Motor Vehicle Air Conditioners containing ozone-depleting refrigerant). Previous Enforcement Actions: Based on a review of the EPA's Enforcement and Compliance History Online database ("ECHO"), there have been no formal or informal enforcement actions against this facility in the last 5 years. Opening Conference: Mr. Mohamoud arrived at Kelly Honda, located at 540 Lynnway, Lynn, Massachusetts, at 11:00 am and met Said Bousbaa, Kelly Honda's General Manager. Mr. Mohamoud presented his inspection credentials to Mr. Bousbaa and explained the purpose of the inspection was to evaluate Kelly Honda's compliance with any applicable Clean Air Act regulations specially the regulation that pertaining to the Ozone Protection. Mr. Bousbaa allowed the EPA inspector to ask questions and proceed with his inspection. Mr. Mohamoud asked whether Kelly Honda services motor vehicle air conditioners ("MVACs") that contain refrigerant and Mr. Bousbaa said yes that Kelly Honda does. Mr. Bousbaa called Eber Nabariet, Kelly Honda's Service Manager, to join the meeting. Mr. Mohamoud again asked if Kelly Honda services MVACs, and if Kelly Honda hires EPA MVAC certified technicians to service automobile air conditioners. Mr. Mohamoud also asked if Kelly Honda has refrigerant recovery machines to recover refrigerant from the automobile air conditioners. Mr. Nabariet said yes to all three questions. Mr. Mohamoud asked how many refrigerant recovery machines Kelly Honda has, and Mr. Nabariet said Kelly Honda has four recovery machines. Mr. Mohamoud asked how many EPA MVAC certified technicians Kelly Honda employes, and Mr. Nabariet said one. Mr. Mohamoud asked if one certified technician uses one recovery machine, who uses the remaining three. Mr. Nabariet said other mechanics, who are not EPA MVAC certified, but are Honda certified use Page 2 of 3 Kelly Honda Lynn, MA them. Mr. Nabariet said that before Kelly Honda employs mechanics they must take a test given by Hoda Corporation, which includes MVAC test, and pass that test to become Honda certified. The mechanics must pass this test before they are allowed to work on vehicles. Mr. Mohamoud asked if Mr. Bousbaa and Mr. Nabariet are aware of any incidences where refrigerant had been released to the atmosphere from automobiles serviced at Kelly Honda and both men said that they were not.
