Memorandum to OSHA File

Bevil Hart o the Beaumont OSHA office telephoned J. L. Wescoat Wednesday afternoon, January 2, 1980, to relay some information associated with the inspection conducted September 12, 1979.
Hart advised the following:
1. The buli. (pinch) samples of scrap insulation that he picked up from the ground and platforms in the TCC 2/3 and TCC 4/5 areas did contain asbestos.
2. Personnel breathing zone samples taken from: Mobil employees showed asbestos to be non-detactabla.
3. Personnel breathing zone samples taken on Commercial Metals Corporation employees did show some level of asbestos. Hart did not state the magni tude of the asbestos in these ssmples.
4. Hart is progressing a citation against Commercial Metals Corporation. This is primarily because of the absence of a viable program for protecting their employees and because of the way they were handling asbestos scrap.
5. OSHA does not plan to recommend a citation against Mobil. Hart stated that Mobil could be cited along with the contractor because of the looseasbestos scrap mentioned in Item 1 above and because of the performance and behavior by the contractor. Hart stated that this decision was reached as a result of his own observations while at the refinery and subsequent con versations with OSHA people and a number of Mobil employees.
6. Standard 1910.1001 (f)(4), copy attached, states that ". Affected employ ees, or their representatives, shall be given a reasonable opportunity to observe any monitoring required by this paragraph and shall have access to the records thereof.'* Hart went on to emphasize that access to information such as sampling results is just as much a part of the standards as other parts' and we could be cited for willful violation on this item if the employees' complaints are judged to be valid by OSHA.
