Q The claimant's attorney, John Larsen, called me 7-27-88. He
S had just become aware that the Clerk of the Circuit Court, Montgomery County, had already certified its record to the
Fifth District Appellate Court, in Mt. Vernon. The Circuit Clerk had also sent Larsen a complete copy of the record,
which is a bit unusual. He therefore prepared a Notice of
Filing of Record on Appeal, a copy of which is attached. Larsen's a little uncertain about the briefing schedule, and
if I understood him correctly, will be filing Appellant's
Brief on or about August 3, 1988. That may be a little premature in that the Court usually publishes a briefing
schedule for the parties.
I did mention settlement to him, and he threw out the figure $75,000.00.
At the moment then we are waiting two happenings:
1. The probability that we will get a briefing schedule from the Appellate Court, Workers' Compensation Division; the second, Mr. Larsen's Brief.
According to Supreme Court Rules, we have thirty-five (35) days after the Appellant's Brief is due, in which to file Appellee's Brief.
