Mr. George Marshall and Mr. Vergel Perry will finalize the date and send out the announcement. Dr. Has Shah will check with Mr. Mike Lunsford and Mr. Gerry Jordan to determine if a workshop in the Lake Charles area should be held. 3.0 Mr. Peter de la Cruz reviewed his conversation with Mr. Charles Gordon and Mr. Daniel Boyd regarding the impact of OSHA's Vinyl Chloride Standard on a company's emergency response activities, especially when it is necessary to enter an environment of 36,000 ppm vinyl chloride or more to respond to emergency situations. Mr. Gordon and Mr. Boyd expressed the opinion that the Vinyl Chloride Standard is not intended to preclude such activities. Mr. Perry mentioned that the October 25, 1993 HAZWOPPER Standard supports this interpretation; however, it does not address how far the emergency response team can go, 4.0 The Panel members identified an emergency response capability gap for transportation of vinyl chloride between Texas and California. Mr. Perry and Mr. Marshall are working on determining the railroad emergency response capabilities on this route. Dr. Shah will identify additional "for-hire" contractors on this route through CHEMTREC. The Panel members also identified a need for an emergency response team in the Little Rock, AR, area. Dr. Shah will request a proposal from SpilTech Services to provide emergency response services specifically for the Little Rock, AR, area. CMA 111792 ROCC December 9, 1993 Page 2 The Panel members agreed that Materials Management Group and Weavertown Environmental Group's response capabilities are duplicative of OH Material and EmTech and therefore will not be considered further for contractual agreements. 5.0 Mr. John Klimavicz mentioned that he had received comments on the draft vinyl chloride brochure only from one company. All Panel members were requested to thoroughly review the draft and send in their comments to Mr. Klimavicz by December 31. 6.0 Mr. Perry will contact Mr. Dean Smith to send information on the LSU emergency response training program and its importance to the chemical industry to Dr. Shah. Upon receipt of the information, Dr. Shah will send a letter to LSU supporting its efforts. 7.0 Dr. Shah will follow-up with Mr. Lunsford on the status of the edit on the vinyl chloride safety video. Any final video will have to be approved by member company management and CMA. 8.0 Mr. Perry proposed that the Vinyl Chloride Network recommend to the Interindustry Rail Group that all future pressure tank cars be designed in such a manner that they would be capable of accepting a commercially available capping kit. 9.0 Dr. Shah informed the Panel that a VCNet drill is scheduled for the next week. The drill will be limited to VCNet member companies and will be outside of normal business hours. Dr. Shah mentioned that he does not plan to drill non-VCNet members because they are not part of the VCNet system and may raise many questions as to the purpose for the drill when they do not ship any significant volume of vinyl chloride. 10.0 The Panel members discussed the Department of Transportation's proposed rule on Crashworthiness Protection Requirements for Tank Cars (Fed. Reg. 58, 52575). The Panel agreed that the proposal does not adversely impact the vinyl chloride transportation mode; however, it will have an adverse impact on the transportation of other chemicals. The Panel therefore will not file comments on the proposed rule. 11.0 The January 24, 1994 Panel meeting in Corpus Christi is cancelled.
