EPA inspector met with Justin DeLong (owner/operator) and Mike Perrier (BIA). This was an EPA inspection in response to a spill report (NRC #1400167), which was received by EPA Region 6. The inspection was conducted under the authority of the Clean Water Act (CWA) to ensure compliance with Environmental Protection Agency (EPA) regulations. No other local, state, tribal or federal partners were present at the time of the inspection. FACILITY DESCRIPTION EPA conducted an inspection at the WELLCO Energy, Inc./Anderson-Cottonmouth Lease. The facility consisted of the Anderson-Cottonmouth lease tank battery, the Anderson #4 well, and the remaining connected wells and flowlines. Section II - OBSERVATIONS I observed the Anderson #4 well and the facility signage. The Anderson #4 was the release point of the spill. The -inch gauge blew off the well, causing saltwater to spill onto the land surface, filing and overtopping the containment berm. See Photos No. 1 and 2 of Appendix 1 (photo log). For additional GPS location information and photo metadata, see the attached photo log. I observed the point of entry (POE) and a temporary containment dam, which had been placed by the operator to prevent downstream migration of spill impacts. The spill only impacted one (1) pool of water in the unnamed tributary (UT) of Birch Creek. At this same location, I observed an elevated TDS field reading of 3,578 mg/L. At the time of the inspection, the operator was pumping the impacted water from the tributary with a gasoline water pump as well as a vacuum truck. See Photos No. 3 and 4. I observed a background TDS field reading of 659 mg/L taken upstream from the POE. This observation should be used when determining background TDS levels for the area. Section IV - FOLLOW UP Inspector will conduct a follow-up inspection to ensure impacted waters were removed from the impacted tributary.
