At this time, it appears that a consumer paint label will be required under HR 3554. Rep. Ritter (R, Pa.), ranking minority member of the House Energy and Commerce Committee's Subcommittee on Transportation and Hazardous Materials, has proposed the labeling language on the following page, as a means of supporting ongoing KVA efforts to communicate lead hazards. The thrust of the ERA effort is to advise the public of "simple solutions" for avoiding lead exposure. The label statement is seen by its proponent as a supplement to other communications mechanisms (by e p a and the private sector, including NPCA). Childhood lead poisoning prevention advocates are pressing fur more onerous label statements regarding lead-baaed paint hazards and the need for dramatic and costly action. Congressman Ritter's proposal is an attempt to ward off such inflammatory language with statements that are consistent with and supportive of current and proposed agency programs. The issue is whether we, as NFCA, can support this suggested labeling language as constructive partners in this part of the legislation, consistent with our past proactive efforts on the lead issue (and with the understanding that, some sort of labeling language is a given). Bear in mind that there will be a two-year grace period between promulgation of the language and a requirement that it appear on labels of products currently regulated by the CPSC.
