Inspector met with Mr. Brandon Hickey (Owner) at the Opening Conference. Inspector presented their credentials to Mr. Hickey and informed him that this was an EPA inspection to determine the facility's compliance status with the Concentrated Animal Feeding Operation (CAFO) regulations as authorized by Clean Water Act (CWA) Section 308. The scope of the inspection included a compliance evaluation of the facility's site operations and record keeping determining the designation of the facility as a CAFO. For biosecurity purposes, the inspector toured the site in over-boots. Inspector was accompanied by Mr. Hickey. FACILITY DESCRIPTION Elk City Livestock Auction reported that they have sold a total of 73,797 combined cattle in 2022. They sell beef bovine and a few dairy cattle. Auctions are held Friday every week forty-eight weeks out of the year unless it is a holiday. Animals are housed for approximately 48 hours for each sale. Animals are housed in open pens with a few covered pens. Pens are cleaned via scraping as needed using a skid steer. Lot scrapings are piled and then given away to 3rd party farmers. Mortalities are hauled off and buried as needed within 24 hours. The livestock market uses hay and pellet feed. Pellet feed is stored in sacks and some hay is covered. The site pumps to the city sewer system. The facility is sloped to direct all runoff to a grated manhole at the west end of the facility and pens. There are also drainage channels in the center of the pens that help direct runoff to the grated manhole. There is a large berm on the north side that prevents runoff from entering the nearby city drainage ditch. Before the inspection, city workers had chopped down a lot of vegetation on the north berm. Berms also surround the other perimeters of the facility to keep runoff from flowing offsite. Section II - OBSERVATIONS Elk City Livestock Auction has the animal numbers required to meet the large CAFO regulatory definition based off their 2022 reported sales. Elk City Livestock Auction is well managed and organized. No potential issues were found during the inspection. Section III - AREAS OF CONCERN There were no areas of concern found at the time of the inspection. EPA Region 6 inspector conducted a closing conference for the Elk City Livestock Auction inspection at approximately 1:34 p.m. on June 13, 2023. During the closing conference, the inspector reviewed findings with Mr. Hickey and provide him with a compliance assistance brochure.
