Will this development delay the timetable Administrator Pruitt has shared with lawmakers? (He has testified that he expects to have the current effort completed this year.)
On Friday, June 15, EPA and the Army sent the " step 2" W OTUS regulation that would redefine "waters o f the United States" to the Office o f Management and Budget for interagency review. The agencies will issue the proposed redefinition for public comment after the interagency review process is complete. The agencies continue to review comments on the July 2017 step 1 proposal and look forward to hearing from the public on the supplemental proposal signed last week.
Could EPA be more specific on the public input it is responding to with this new request? Was someone unsure of EPA*s intention on WOTUS? Was this new request legally required to ensure EPA could complete its plan to replace the 2015 rule?
The agencies are issuing the supplemental notice o f proposed rulemaking to give the public an opportunity to comment on the additional considerations that support the agencies' proposed repeal, some o f which the agencies did not discuss in detail in the initial Step One proposal. The agencies are continuing to review the comments received on the J uly 2017 proposal.
Please see Section I.D " Comments on the OriginalNotice ofProposed Rulemaking'' which describes the nature o f some o f the comments the agencies received indicating that commenters were confused about the scope o f the agencies' proposed action.

I have a few follow up questions to EPA's announcement on Friday that it would be seeking additional comment on its efforts to repeal W OTUS.
- Will this development delay the timetable Administrator Pruitt has shared with lawmakers? (He has testified that he expects to have the current effort completed this year.)
- Could EPA. be more specific on the public input it is responding to with this new request? Was someone unsure o f EPA's intention on W OTUS?
- Was this new request legally required to ensure E P A could complete its plan to replace the 2015 rule?
