WERTZ Re: #3, et al. WCAB Case No: dec'd) v. Kaiser Shipyard OAK 141300 Dear Ms. Del Vecchio: Enclosed herewith, please find some interesting correspondence from applicant's attorney enclosing Compromise and Release and an Order Approving Compromise and Release of $180,000 against Kaiser shipyards. What affect, if any, this will have on Kaiser Shipyards' action against Sherwin-Williams Company cannot be ascertained at this point. We would anticipate that counsel for Kaiser will proceed with the settlement conference of December 5, 1988, and hope to make a recovery against Sherwin-Williams for at least part of benefits provided to Mr We presently have the matter on calendar for December 5, 1988, and will, of course, attend that conference proceeding, and advise you as to the results. We were not really surprised with the settlement because counsel for Kaiser definitely had exposure in the longshore forum, as well as the State workers' compensation forum. The amount of the settlement would appear to encompass any longshore exposure; but, that is not specifically set forth 0007-SWP-005803578 CONFIDENTIAL s is Re: November Page Two 11, 1988 REDACTED , dec' d) HOVz in the Agreement. We hope to have further clarification following our attendance at the conference. We will, of course, continue to keep you apprised of progress; and, we hope to be discussing this matter with some of the co-defendants before the actual conference takes place.
