Yal cinkaya y Gentlemen: On September 28, 1979, Mr. Alan Trivette, an OSHA Industrial Hygienist, came to the Texas City Plant to investigate an employee complaint regarding exposure to "road dust" from the road north of the #3 Olefins furnaces. Mr. Trivette, J. B. Leverton, Sam Munn - a bargaining unit representative 0. H. Cunningham, and H. R. Schulz held an opening meeting in which it was explained to Mr. Trivette that we had to stop oiling nonpaved roads in an attempt to reduce violations of the oil and-grease parameter of the stormwater permit. It was further explained to Mr. Trivette that a policy was in effect whereby a supervisor with a dusty road could call the vacuum truck dispatcher who in turn would have the road watered. Shortly thereafter, Messrs.-Trivette, Munn, and Schulz toured the area in question which affirmed that the road would indeed become dusty when dry. No samples were taken. The group returned to Bldg. 1 for a closing conference whereupon Mr. Trivette asked for some program from Union Carbide to reduce the dust problem. Mr. Trivette was told that we would assess the situation and respond to him by the following Wednesday, October 3. Mr. Trivette then left the plant. ; On October 3, Mr. Trivette was contacted and was told that until a suitable alternative was found to oiling the roads, the plant policy on watering would remain in effect. He was informed that we would reaffirm this policy to the area maintenance employees by having Mr. Charlie Phinney, Area Maintenance Superintendent, issue a letter explaining the watering policy. Taylor called Mr. Davis Layne, Area Director for OSHA, and spoke to him of the seeming harassment in this type of complaint. Mr. Layne replied that the complaint was a formal written complaint and that it was OSHA's policy to follow up all formal complaints.
